The Council of City of Waterloo, Iowa, met in Regular Session in Council Chambers
in the City Hall at 7:00 P.M., on February 26, 1979. Mayor Rooff in the Chair.
On roll call, Present: Bowers, Burton, Dowie, Getty, Roehr, Wilharm. Absent:
Hutchison. Invocation by Councilman Wilharm.
75822 - Moved by Roehr, seconded by Bowers that the Agenda, as amended, for the
Regular Session of February 26, 1979 at 7:00 P.M., be accepted and
approved. Motion carried.
75823 - Moved by Burton, seconded by Wilharm that the Minutes of the Regular Ses-
sion held February 19, 1979 at 7:00 P.M., be approved. Motion carried.
75824 - Moved by Dowie, seconded by Bowers that proof of publication of Notice
of Bond Sale of $180,000 Street Improvement Bonds for F.Y. 1978 Paving
Program, Contract #162, and $200,000 Sewer Improvement Bonds for Triangle
Terrace & Suburban Heights Sanitary Sewer Improvement Project, 1978 #1,
Contract #189 (Special Assessments), be received and placed on file.
Motion carried.
75825 - The Mayor announced that this being the time and place for the opening
of bids for the sale of $180,000 Street Bonds and $200,000 Sewer Bonds,
the meeting was thrown open for the receipt of bids for said bonds. ,
Moved. by Roehr, seconded by Wilharm that the following sealed bids be
received, placed on file but NOT OPENED:

of public hearing on site development plan for proposed parking area and

way and Kimball Avenues, an "S-1" Shopping Center District, upon recom-
mendation of Plan and Program Commission and Council's own motion, as
published in Waterloo Courier on 2/9/79, be received and placed on file.

75829 - This being the time for hearing, the Mayor called for oral and written
objections and there were none. Hugh Field supported approval.
Moved by Bowers, seconded by Wilharm that "Resolution approving site
development plan for proposed parking area and visitor building for
Schoitz Memorial Hospital at SE corner of East Ridgeway Avenue and Kimball
Avenue", be adopted. Ayes: Six. Absent: Hutchison. Resolution adopted
and upon approval by Mayor, assigned No. 26195.
75830 - Jim Miller, 3913 Crossway Drive, presented a petition against permitting
a beer and liquor license to property owners on University Avenue, that
lies West of 3909 University Avenue and East of 4003 University Avenue,
in Cedarloo Park Addition, stating the deed of dedication contained a
no sale of beer or liquor convenant.
Moved by Roehr, seconded by Burton that the above petition be recieved
and placed on file. Motion carried.
75831 - Councilman Roehr strenuously protested the following motion on applica-
tion for 95 units of Section 8 Housing as out of order as Councilman
Bowers and Dowie did not vote on the prevailing side on 2/12/79.
Assistant City Attorney Kennedy stated the city ordinance on prevailing
side applied only to the next following meeting. Mayor Rooff stated as
number of units was reduced , the public hearing would not need to be
rescheduled. Councilman Roehr favored the City taking over the subsidized
housing program and Mayor Rooff emphasized it should be kept out of the
political arena. Chamber of Commerce Director Meeker reported it cost
the City up to $45,000 to manage 55 units and the Chamber now manages
271 units for the City for up to $14,000, and offered to make oral
quarterly reports to the Council. The Council requested a list of resi-
dents and tenants, exact number of housing, etc.
Moved by Bowers, seconded by Dowie that communication from Waterloo Cham-
ber of Commerce changing Housing Application of Section 8 Existing Hous-
ing from 100 units to 95 units, be received, placed on file, approved
and "Resolution approving and authorizing the Waterloo Chamber of Com-
merce to submit an application to the Federal Housing Administration for
95 units of H AT.D. Section 8 Existing Housing for Waterloo, Iowa", be
adopted. Ayes: Bowers, Burton, Dowie, Getty. Nays: Roehr, Wilharm.
Absent: Hutchison. Resolution adopted and upon approval by Mayor,
assigned No. 26196. Councilman Roehr challenged City Attorney's position
and said an Attorney General's opinion was needed.
75832 - Moved by Bowers, seconded by Getty that request of Oran Wingler for
Council on its own motion to rezone from "R-2" One and Two Family Resi-
dence District to "C-2" Commercial District, approximately 12 acres South
of Newell Street between City View Street and Springview Street, being all
of Block 12 except S 136' and the W 180' of N 136' of Block 27, all in
City View Heights, for business purposes, together with 86% remonstrance
petition and City Zoning Commission's recommendation for denial, be re-
ceived, placed on file, recommendation approved and request denied. Ayes:
Six. Absent: Hutchison. Motion carried.
75833 - Moved by Roehr, seconded by Dowie that request from Caras, Inc. for
Council on its own motion to rezone from "A-1" Agricultural District to
"R-1" One and Two Family Residence District and "R-3" Multiple Residence
District approximately 45 acres East of Hoff Road and South of proposed
Freeway 520, as shown on attached plat and legally described in Attach-
ment "A", for single and multi -family residential unit purposes, and City
Zoning Commission's recommendation for approval, be received, placed on
file, recommendation approved, date of hearing set as March 19, 1979 at
7:00 P.M. and Clerk instructed to publish notice. Motion carried.
75834 - Moved by Bowers, seconded by Wilharm that request of Waterloo City Zoning
Commission for Council on its own motion to rezone from "U-1" Unclassified
District and "R-4" Multiple Residence District to "M-1" Light Industrial
District approximately 10 acres South of Falls Avenue and East of Black
Hawk Creek, as shown on attached plat and legally described in Attachment
"A", for business purposes, and City Zoning Commission's recommendation
for approval, be received, placed on file, recommendation approved, date
of hearing set as March 19, 1979 at 7:00 P.M. and Clerk instructed to
publish notice. Motion carried.

Council on its own motion to rezone from "A-1" Agricultural District and
"R-3" Multiple Residence District to "R-1" One and Two Family Residence
District, "R-2" One and Two Family Residence District, "R-4" Multiple
Residence District, and "C-1" Commercial District and real property lo-
cated West of Kimball Avenue and North of U.S. Highway 412, as shown on
attached plat and legally described in Attachment "A", for residential
and commercial development purposes, and City Zoning Commission's recom-
mendation for approval, be received, placed on file, recommendation
approved, date of hearing set as March 19, 1979 at 7:00 P.M. and Clerk

75836 - Discussed was City's furnishing a lift station and City's liability on
private property.
Moved by Roehr, seconded by Bowers that petition of Mr. and Mrs. Richard
Rubendall, 168 Sans Souci Drive, etal, for installation of sanitary sewer
on Sans Souci Drive, be received, placed on file and referred to the City
Engineer. Motion carried.
75837 - Discussed was West Ninth and Washington Street area having the worse
accident report.
Moved by Burton, seconded by Getty that request of Schenk Engineering
Company for Kathleen Gable, together with IDOT Entrance Permit Application
Form 640004, for permission to construct one 30' commercial curb cut,
Type "B" entrance, on Highway 218, Sta. 410+22, approximately 191.3' SEly
along Highway 218 from centerline of West 9th Street, 1104 Washington
Street, and City Engineer's recommendation for approval subject to the
provisions of hi.s letter, be received, placed on file, approved and Mayor
authorized to sign said application. Motion carried.
75838 - The Finance Director and Attorney, having checked the bids submitted for
the $180,000 Street Improvement Bonds and $200,000 Sewer Improvement Bonds
being offered for sale in connection with F.Y. 1978 Paving Program, Con-
tract #162, and Triangle Terrace & Suburban Heights Sanitary Sewer Improve-
ment Project 1978 bbl, Contract #189, respectively referred to them by
Council Action #75826, reported after checking the bids, the bid of
Peoples Trust & Savings Bank of Indianola, Iowa, being an effective in-
terest rate of 6.1468% was the best bid received for the $180,000 Street
Improvement Bonds, and the bid of Shaw,McDermott & Co. of Des Moines, Iowa,
being an effective interest rate of 6.3250% was the best bid received for
the $200,000 Sewer Improvement Bonds.
Moved by Burton, seconded by Dowie that "Resolution directing sale of
$180,000 Street Improvement Bonds and $200,000 Sewer Improvement Bonds"
be adopted, and the Clerk instructed to return the certified checks to
the unsuccessful bidders. Ayes: Six. Absent: Hutchison. Resolution
adopted and upon approval by Mayor, assigned No. 26197.
75839 - Zoning Director Franke reported the contractors wanted another meeting on
the Zoning Ordinance amendment. and requested that action on the third
passage be deferred until March 12, 1979.
Moved by Bowers, seconded by Burton that the above request be received,
placed on file, and action on third passage of An Ordinance amending
Ordinance No. 2479, known as the Zoning Ordinance, be deferred until
March 12, 1979. Motion carried.
175840 - Councilman Burton questioned if this grade ordinance would tie the City in
so nothing could be added and he was assured it would not.
