RESOLUTION NO. 2015-620
RESOLUTION APPROVING AN ENCROACHMENT
AGREEMENT WITH AGM, LLC TO ALLOW FOR THE
CONSTRUCTION OF A PARKING LOT 14 FEET WITHIN
THE RIGHT-OF-WAY, LOCATED AT 2864 BURTON
AVENUE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
that the Encroachment Agreement dated August 3, 2015, to allow
for the construction of a hard surfaced parking lot on the west
side of the existing building which would encroach fourteen (14)
feet into the existing right-of-way, located at 2864 Burton
Avenue, legally described as follows:
The Easterly 14 feet of the Public Right of Way of Burton
Avenue, said Line of Public Right of Way is Coincident with
the Westerly Line of Lot 1 of Burton Avenue Industrial Park,
in the City of Waterloo, Black Hawk County, Iowa, lying
adjacent to said lot 1 Southerly of the Northerly Line of
said Lot 1 extended, and Northerly of the Southerly Line of
said Lot 1 extended, excluding the Northerly 50 feet
thereof.
Between AGM, LLC, and the City of Waterloo, Iowa, is hereby
approved, and the Mayor and City Clerk are authorized and
directed to execute the same on behalf of the City of Waterloo,
Iowa.
PASSED AND ADOPTED this 3rd day of August 2015.
