The Council of the City of Waterloo, Iowa, met in Regular Session at City Hall Council
Chambers, Waterloo, Iowa, at 5:30 p.m., on Monday, December 14, 2009. Mayor Timothy J.
Hurley in the Chair. Roll Call: Cole, Getty, Hart, Greenwood, Steve Schmitt, Welper,

Prior to a vote on the above motion, the following comments were heard.
Mayor Hurley stated that the amount will go back to the state and the state will
resubmit it to the Metropolitan Planning Organization (MPO) that handles
transportation issues. He stated that it will come back as STP monies and the
only downer on that is when we find a project for it, it will require a local
match of 20 percent. Mayor Hurley stated that it will be 80/20 coming back,
however, most states took their money and ran with it, but the State of Iowa is
putting underused money back into the communities.
Following comments a vote was taken on the above motion with the following

the overlay program this year.

that "an Ordinance amending the 2007 Code of Ordinances of the City of Waterloo,
Iowa for the Storm Water Management Program", be received, placed on file,
considered and passed for the second time.
Prior to a vote on the above motion, the following comments were heard.
Councilperson Welper stated that he received a phone call from a citizen that
does not have storm water drains. The citizen stated that the water simply runs
off their property into the ground and the citizen asked why they have to pay
for the fee. Mayor Hurley stated that he also spoke to a citizen with similar
questions. Mayor Hurley stated that we have to look at things bigger than just
our front door of our property lines in that we all share the costs and
responsibilities imposed on us by the federal EPA and the Iowa DNR about clean
water. Mayor Hurley stated that it was in the early 1970s that the Cuyahoga
River in Cleveland, Ohio caught fire because of the contaminants in it. Mayor
Hurley stated that's when the EPA got very active and clean water being
everyone's right and that is what started the ball rolling.

Ordinances to be Adopted continued
Mayor Hurley stated that we have a responsibility about that whether we like it
or not because it is imposed on us. Mayor Hurley stated that everyone benefits
from the storm water drainage system, even those that lack full streets. Mayor
Hurley stated that ultimately all of the water drains somewhere. He stated that
right now we are laboring under some pinched budgets that come out of
Engineering, Street and Waste Management Departments in dealing with storm water
and sewer problems. Mayor Hurley stated that sometimes in order to get on top
of those we borrow money, pay interest on them and that certainly hits our
property taxes. Mayor Hurley stated that this kind of funding and fees will
provide some potential relief for property taxes. Mayor Hurley stated that it
also allows us to go further with our sewer, engineering and street funds.
Mayor Hurley stated it is possible that in the code of uses in the storm water
fund that we might not be able to look at a street with curb and gutter and
improve it in conjunction with some other fund. Mayor Hurley stated that if a
citizen is having problems they should contact the Street Department or Mayor
and someone will get out there to take a look to see if something can be
improved.

Prior to a vote on the above motion, the following comments were heard.
Forest Dillavou, 1725 Huntington Road, stated that it appears that the funds
will be used to pay for things that citizens are already being taxed for and are
being paid for, old services. He stated that he understands from last week's
meeting that it will be put in a fund that has other monies in it and it will
not be a separate fund. He stated that there will be no tracking as to how it
is used or where it is used. He stated that he knows that storm water needs
some real attention because his neighborhood has needed it for 20 years. Mr.
Dillavou stated that if it is used to pay for old funds, there would not be
enough to take care of his neighborhood that needs some of this done. He stated
it sounds like this is a way to balance a budget. Mr. Dillavou stated that the
City found a way to get the $1 million it will be short with a new tax for the
citizens. He stated it was talked about putting the fee with the Water Works
and having them collect it for the City. Mr. Dillavou stated that having Water
Works collect the funds is fine, but we don't have enough deposit to cover non-
payment from renters when they move out. He stated that they normally have
enough to cover for the water, but if a tenant moves out and does not pay for
the sewer, garbage and now storm water, that falls back on the property owner.
Mr. Dillavou stated that he would like to encourage the council to increase the
deposit so that it would be enough to cover the three-month period. He stated
that this is adding another burden to the property owner that rents.
Mayor Hurley stated that the monies will be put in a separate fund, be audited
and tracked. He stated that it is not a way to balance the budget because it
can't be mixed. He stated it will relieve some budgets and things that we are
doing now very inadequately. He stated it will save the city from being fined
up to $25,000.00 a day by the EPA for not being in compliance. He stated that
the Waterloo Water Works will collect because it is more convenient to do so and
will appear as another line item on the bill. He stated that the idea of a
deposit was discussed but it is an awful lot of expense for $2.75 per month so
at this time there is not a deposit for the storm water fee.

Prior to a vote on the above motion, the following comments were heard.
John Sherburne, 1715 Robin Road, stated that in 2007 he came to a council
meeting and asked if it was going to be a problem when a car is washed at a
property. He stated that it could become a problem. Mr. Sherburne stated that
he called today to the Water Works and asked how much it is going to cost him
for the fees at a particular car wash business. He stated that he was referred
to the Engineering Department and he was told that he would be contacted later.
He stated that he still has not been contacted and has talked to several other
businesses and no one knows anything about the business categories. Mr.
Sherburne stated this is not really a fee increase, it is a new tax because it
doesn't involve anything new. He stated that all work will be done with old
staff in place. Mr. Sherburne asked about the schools and churches. He stated
that the citizens donate their money to the churches and donate to businesses by
buying their product. Mr. Sherburne stated that citizens are paying three times
that fee. He stated that no one knows how much the fees really cost. Mr.
Sherburne asked if there are a list of projects that are going to be done and
what the cost is for each project.
Mayor Hurley stated that he respects Mr. Sherburne's opinion about this being a
blind side deal, although this has been discussed and work sessions done since
2007. Mayor Hurley stated the city has spent money on a consultant to help with
business properties and working on the ordinance. Mayor Hurley stated this is
not something going into place because we want to, but because we have to. He
stated that Mr. Sherburne should make his voice heard to State and Federal
Legislators also about unfunded mandates because that is what we are dealing
with. Mayor Hurley stated that the reason why he has not received a response is
because computer software is being used to calculate the square footage of every
business and the fees vary. He stated some examples of some properties already
configured for fees. He stated the only properties that were exempted were some
rail lines and the City of Waterloo. He stated that there are several other
cities that already have the fee in place.

ORAL PRESENTATIONS
130389 - Dwayne Eilers, P.O. Box 583, is a citizen of Waterloo and has spoke to the
Council about his home at 1708 Lafayette Street. He stated that he took the
Mayor's word that he would call him and is still waiting for a response. He
stated that he is offering to meet with anyone to inspect his home. Mayor
Hurley responded that an electrical contractor has not contacted the Building
Department for an inspection and the City does not go out until the request for
inspection is made. Mayor Hurley stated that Mr. Eilers was very heated in his
approach to Council on Monday, December 14, 2009. Mayor Hurley shared the
inspection notes for 1708 Lafayette Street of May 13, 2009 with Council. Mr.
Eilers asked about what the notes have to do with the electrical. Mayor Hurley
asked Mr. Eilers if he has an electrical contractor. Mr. Eilers responded yes
and he fired him along with the City Inspector. Mayor Hurley asked Mr. Eilers
if the electrical contractor contacted the Building Department for an electrical
inspection. Mr. Eilers responded that the Building Inspector called him and
said the electricity was being shut off because he would not pay the
electrician. Mr. Eilers stated that he was unhappy with the job his electrician
did and the Building Inspector said that he was cutting off the electricity
unless Mr. Eilers paid the electrician. Mayor Hurley stated that if he would
like the city to come out and inspect the property, he has to have a bonded and
certified electrical contractor like everyone else to call the Building
Department to request an inspection for the work that was done. Mr. Eilers
stated it is a private home, his son's home, and he lived in the home for 8
years. Mr. Eilers stated that he requested a private electrical inspector with
his son. Mr. Eilers stated that the electrical inspector won't grant the
inspection and asked why not. Mr. Eilers asked if there were special favors
being done for someone.

Jessica Crouch, 2257 Country Lane, stated that last year Mayor Hurley and his
staff helped with a Build A Bag fundraiser for the victims of the tornados and
floods. Ms. Crouch wanted to present a thank you from the CEO and a shirt. Ms.
Crouch read the thank you letter aloud to Mayor Hurley and Councilmembers.
