In connection with obligations in favor of the Florida Department of Transportation only, it is agreed that the power and aut hority hereby given to the
Attorney -in -Fact includes any and all consents for the release of retained percentages and/or final estimates on engineering and construction
contracts required by the State of Florida Department of Transportation. It is fully understood that consenti ng to the State of Florida Department
of Transportation making payment of the final estimate to the Contractor and/or its assignee, shall not relieve this surety company of any of
its obligations under its bond.
In connection with obligations in favor of the Kentucky Department of Highways only, it is agreed that the power and authority hereby given
to the Attorney -in -Fact cannot be modified or revoked unless prior written personal notice of such intent has been given to the Commissioner -
Department of Highways of the Commonwealth of Kentucky at least thirty (30) days prior to the modification or revocation.

Memo to Waterloo Mayor and City Council:
RE: Upgrade and replacement of WM Admin HVAC cooling system
Background Discussion
Last year the air conditioning system for the administration building failed resulting in two
temporary cooling units to be installed. Due to the complexity and requirement to
competitively bid the upgrade and replacement units, Kapaun Consulting Engineers was hired
to engineer and prepared plans and specifications for this project.
Bids were opened on May 17, 2018 and read at the May 21, 2108 city council meeting.

Those bids greatly exceeded that the engineers estimate. One of the major issues related to
proprietary control units which such pricing was $50,000 greater than the engineer's estimate.
At the May 21St meeting, after initial discussions with the design engineer he was
recommending rejecting all bids and redoing the project in separate phases. Ongoing
conversations with our legal department raised some concern with that approach. In the end,
it has been decided to be in the best interest to accept the low bid and work with the low
bidder to modify the controls section of the project via a change order.
Recommended Action
It is recommended that the city council approve the resolution approving award of contract to
Young Plumbing & Heating in the amount of $189,800. It is fully expected that a change order
will be brought back to the city council for a reduction for the controls portion of the contract.
At that time, it is also expected that related revisions for add alternate no. 1 will be brought
forth for consideration.
