GETTY COUNCIL CHAMBERS Monday, May 14, 2018 5:30 PM CITY OF WATERLOO GOALS 1. Support the creation of new, livable wage jobs through a balanced economic development approach of assisting existing businesses, fostering start-ups, attracting new employers and cultivating an adequate workforce. 2. Implement a Community Policing strategy that creates a safe environment in Waterloo. 3. Reduce the City's property tax levies through a responsible balance of cost reduction in City operations and increases in taxable property valuations to ensure that Waterloo is a competitive, affordable, and livable city. 4. Enhance the image of Waterloo and the City to residents and businesses inside and outside of the community. General Rules for Public Participation 1. At the chair/presider's discretion, you may address an item on the current agenda by stepping to the podium, and after recognition by the chair/presider, state your name, address and group affiliation(if appropriate) and speak clearly into the microphone. 2. You may speak one (1)time per item for a maximum of five(5)minutes as long as you have registered with the City Clerk's office no later than 4:00 p.m. on the day of the Council Meeting. If not registered with the City Cleric's office you may speak one(1)time per item for a maximum of three (3)minutes. 3. If there is a hearing scheduled as part of an agenda item, the chair/presider will allow everyone who wishes to address the council, using the same participation guidelines found in these "general rules". 4. Although not required by city code of ordinances, oral presentations may be allowed at the chair/presider's (usually the Mayor or Mayor Pro Tem) discretion. The "oral presentations" section of the agenda is your opportunity to address items not on the agenda. You may speak one (1)time for a maximum of five (5)minutes as long as you have registered with the City Clerk's office no later than 4:00 p.m. on the day of the Council Meeting. If not registered with the City Clerk's office a speaker may speak to one (1) issue per meeting for a maximum of three (3)minutes. Official action cannot be taken by the Council at that time, but may be placed on a future agenda or referred to the appropriate department. 5. Keep comments germane and refrain from personal, impertinent or slanderous remarks. 6. Questions concerning these rules or any agenda item may be directed to the Clerk's Office at 291-4323. 7. Citizens are encouraged to register with the Clerk's Office by 4:00 p.m. on Monday of the day of the City Council meeting to appear before the City Council(may also register by phone). ORAL PRESENTATIONS Mike Youngblut, Attorney for Deer Creek Development, explained that an agreement has been reached to demolish the Waterloo Greyhound Park. Jim Chapman, 224 Bertch, questioned if he can receive answers on the human resources questioned he submitted. He also questioned if the budget is based on population because each department has stated that they need more staff during Residents' Academy. Major Harold Puff, Salvation Army, explained that the Salvation Army is still interested in purchasing adjacent vacant property and is working on a strategic plan outlining how to move forward. Mr. Morrissey commented on the various upcoming events, including Friday'Loo, Riverloop Rhythms, Bike to Friday'Loo Event, and Bike to School Day. Mr. Schmitt explained he still intends to bring back the discussion of preserving revenue from speeding tickets at a future meeting. Mr. Morrissey questioned Mr. Schmitt's intention. Earl Ramos, 1975 Franklin, explained that he stated that he found out that the zoning has changed and no grandfathering clause exists in the ordinance. Noel Anderson, explained that the council changed the location for allowed sales and that the zoning ordinance does allow grandfathering but the city code does not allow grandfathering. Jeri Thomsberty, 704 Sheridan Road, asked that council ban fireworks. Mr. Jacobs commented that the state pushed the problem down to the cities with no revenue for additional work for police and fire calls. He further explained that fireworks usage is a violation of an individual's right to privacy, causes littering, increases public safety costs, and impacts veterans with PTSD. Mr. Morrissey commented that he is in favor of banning fireworks. Mrs. Juon questioned if another compromise to allow one day. Mr. Jacobs commented that fireworks are problematic to individuals in his ward. Mrs. Klein commented that she does not support the ordinance. Mr. Schmitt questioned the period for calls for service. Dan Trelka, Chief of Police, explained that the calls for service covered the entire use period. Mr. Schmitt commented that from a cost standpoint, people are going to violate the law and it would be beneficial to allow a day to shoot off fireworks. Mr. Jacobs commented that he does not believe fireworks usage should be allowed. Mr. Morrissey commented that the ordinance also requires businesses to post a notice explaining the allowed use. A goal of at least ten percent(10%)for MBE participation on all City funded construction projects that are estimated at$50,000.00 or more. A goal of at least two percent(2%) for WBE participation on all City funded construction projects that are estimated at $50,000.00 or more. Any project funded in part or in total with federal funds shall follow the respective agencies contract compliance program and goals. The Prime Contractor shall make "good-faith efforts" to meet the Contract Compliance MBE/WBE goals. Most recently the two positions were slightly revamped changing the CMOM Specialist to CMOM Coordinator to better align associated work duties. It also provided a minor budgetary reduction. Upon the promotion of Laura Wolff from the CMOM Technician position to the CMOM Coordinator position, her position became vacant. Following approval from the Personnel Requisition Committee and all of the appropriate Civil Service Process, it has been determined that Carrie Lewis is the most qualified to fill this position. Filling of the CMOM positions is critical to ensure continued compliance with the CMOM program. This program outlines all the critical aspects to maintain and provide reports for cleaning, televising and providing general maintenance for the city's sanitary and storm sewer systems. Failure to provide such maintenance and documentation is now subject to daily fines from $200 per day up to $1,000 per day in the future. The proposed plat area will consist of sidewalks throughout the development and there is a pedestrian pathway labeled as Tract G on the preliminary plat that connects the proposed development to Orange Elementary School from Road C. Surrounding land uses and their zoning designations are as follows: North —Agricultural land, zoned "A-1"Agricultural District. South —Agricultural land, zoned "A-1"Agricultural District. East —Agricultural land, zoned "A-1"Agricultural District. West— Single family homes and Orange Elementary School, zoned "R-1" One and Two Family Residence District. The Planning and Zoning Commission unanimously approved the rezone request to rezone 129.16 acres from "A-1"Agricultural District to "R-1" One and Two Family Residence District at their regularly scheduled meeting on March 6, 2018. The City Council approved the first reading of the rezone request at their March 26, 2018 Council meeting. The second reading will be held on April 2, 2018 and is anticipated the final reading would be on April 19, 2018. DEVELOPMENT The surrounding area consists predominantly of agricultural land HISTORY: and single family homes. The Orange Neighborhood was established more than 100 years ago. The majority of the homes there were constructed in the 1960's and 1970's with some homes being built recently. BUFFERS/ No buffers are required for the plat area. SCREENING REQUIRED: DRAINAGE: The plat request would appear to have some impact on drainage in the area, especially considering approximately 4 lots and 2 tracts are partially in the 100-year floodplain for the 129.16 acre development. However, the preliminary plat for the Paradise Estates Addition does denote three storm water detention areas with Tract B on the southwest side, Tract D on the northeast side, and Tract C on the southeast side of the proposed development. In addition storm water drainage easements are identified in the rear and side yards for various lots. The area would likely be able to be removed from floodplain status after the area is graded. The applicant has indicated that they will work with the Iowa Department of Natural Resources to ensure the Special Flood Hazard Area does not contain any floodway. FLOODPLAIN: Approximately 98% of the rezone area in question is not located within a Special Flood Hazard Area as indicated by the Federal Insurance Administration's Flood Insurance Rate Map Community Number 19013C and Panel Number 0311 F dated July 18, 2011. However, portions of Tracts C and D, and portions of lots 134, 135, 178, and 179 are located in the 100-year floodplain, as part of a Paradise Estates Addition-Preliminary Plat P&gLF53f bf 141 April 3,2018 Zone A unstudied stream. PUBLIC /OPEN Orange Elementary is directly adjacent to the proposed plat area, SPACES/ SCHOOLS: which includes a playground area for recreational use. The area is also served by Hoover Middle School and West High School. Lichty Park is also located approximately 1,300 feet to the west of the proposed subdivision. A pedestrian pathway known as Tract G will provide a walking path that connects the proposed subdivision to Orange Elementary School. UTILITIES: WATER, There is an existing 8" sanitary sewer main, 12" water main, and a SANITARY SEWER, 15" storm sewer located underneath Kimball Avenue. In addition STORM SEWER, ETC: there is an existing 10" sanitary sewer main, 6" drain tile, and a 12" inch water main underneath East Orange Road. A 15" sewer main that transitions to an 8" sewer line crosses HWY 21 to serve the development. Matt Mahler with Waterworks indicated that there is enough water capacity to serve the plat area, but adequate water pressure may be an issue in some areas. The developer's engineer has suggested placing in-home booster pumps for properties that lack adequate water pressure. There were concerns regarding the 10" sanitary sewer in East Orange Street about it being too shallow to service the area. So, options will have to be analyzed to determine the best way to serve the southern portion of the development. RELATIONSHIP TO The Future Land Use Map designates the majority of the plat area COMPREHENSIVE as Low Density Residential and Agricultural Residential Potential. LAND USE PLAN: Along Highway 21 is Mixed Residential: Low, Medium, High Density Residential, Professional Offices, and Compatible Commercial. The Comprehensive Plan defines low density residential as residential uses that exist or are planned at a density of less than, or equal to, six housing units per acre. Residential density, for the purposes of the Comprehensive Plan, shall include street and public uses when calculated for vacant or newly developing areas. Brian Johnson with Waterloo Waterworks indicated that water flow is not an issue, but water pressure is an issue. It was also noted that the development of the area will create additional revenue to address the water pressure needs for the area. Hyberger noted that a traffic study will be completed prior to the submittal of the final plat. The Waterloo Engineering Department had concerns regarding the request: noting all easements properly; unnamed streets; additional easements; some needed changes to proposed sewers; etc. The applicant's engineer is reviewing these issues and will be updating these items as part of the final plat. (the "Company"). WHEREAS, City and Company are finalizing the terms of a development agreement concerning a project to be undertaken by Company on certain real property described or depicted on Exhibit"A" attached hereto (the "Property"), located in the East Waterloo Unified Urban Renewal and Redevelopment Plan Area, formerly known as the Airport Area Development Plan area; and WHEREAS, the parties desire that Company have access to the Property to begin certain activities before the Property is conveyed to Company. If for any reason the contemplated sale and purchase of the Property between the parties is canceled or otherwise does not occur, then Company shall promptly remove from the Property all of its personal property and materials or debris that it has deposited on the Property during the term hereof and restore, as nearly as possible, the condition of the Property to that which existed upon Company's initial entry upon the Property hereunder, except as otherwise permitted by express written consent of City. 5. Notwithstanding this Agreement, the parties agree to work cooperatively in good faith to finalize the terms of a development agreement in respect of the Property as expeditiously as possible. 6. APPLICANT(S): Embankment LLC, 549 Sunset Road, Waterloo, Iowa 50701 GENERAL The applicant is requesting to rezone 0.87 acres of land to DESCRIPTION: allow construction of a 7,513 square foot multi-tenant retail center located west of 1203 West Ridgeway Avenue (southeast corner of Ansborough and Ridgeway). SURROUNDING The request to construct the new retail center would not LAND USES AND appear to have a negative impact upon the surrounding area if IMPACT ON proper conditions are placed upon the request. NEIGHBORHOOD: VEHICULAR & The site is served by West Ridgeway Avenue and Ansborough PEDESTRIAN Avenue, both of which are classified as Minor Arterials. Dixon TRAFFIC Drive is located immediately south of the site and is classified CONDITIONS: as a Local Street. The site plan shows revitalization of the three existing driveways, two on Dixon Drive and one on West Ridgeway Avenue being used as access points. On September 1, 2015 Casey's Marketing requested a site plan amendment to construct a convenience store at the site. A traffic impact analysis was completed by the applicant's engineer after the September 1, 2015 Planning and Zoning Commission meeting where the request was tabled, and the conclusion of that report was that there would be traffic impacts created by the new convenience store. The report notes that surrounding street network will operate at a Level of Service (LOS) of C or better in PM peak hours, and it is anticipated that the Casey's development would have generated an additional 38 vehicle-trips during the PM peak hour and a total of 226 vehicle-trips during the PM peak hour. The report noted that a westbound left-turn lane was not warranted at the intersection of Dixon Drive onto Ansborough Avenue, nor from West Ridgeway Avenue into the proposed Casey's General Store. The report also made a recommendation of expanding West Ridgeway Avenue 4.5' on each side to have a 49' wide street across the length of the proposed Casey's site and 100' beyond to accommodate the 95% queue distance and then a 40', 10:1 taper back to the 40' section, allowing for easier maneuverability and better sight distance. The report also stated that a median could be considered along Ansborough Avenue through Dixon Drive, at a future date, if an issue persists. For the previous request, the City Traffic Engineer commented that the proposed Casey's development would have a negative impact on adjacent traffic operations based on the submitted traffic impact analysis, and recommended that Rezone W.of 1203 Ridgeway Page 1 of gage 112 of 141 April 3,2018 different traffic mitigation plans should be evaluated, specifically looking at adding a short turn-lane from southbound Ansborough Avenue left onto Dixon Drive. The Traffic Engineer noted that there were multiple options for increasing adjacent traffic capacity by either adding left turn- lanes on West Ridgeway Avenue, adding a right turn-lane on Ansborough Avenue for westbound West Ridgeway Avenue, or by adding through lanes on both the approach and departure sides of the intersection along Ansborough Avenue. The applicant for the current proposed development is not proposing any additional traffic studies. RELATIONSHIP TO The City of Waterloo has adopted a Complete Streets Policy, RECREATIONAL and it is the intent of that policy to fill sidewalk gaps as TRAIL PLAN AND development occurs. There is sidewalk located directly across COMPLETE STREETS the street on the west side of Ansborough Avenue, which POLICY: connects to nearby retail development to the north. There is currently a traffic study under way looking at the future of Ridgeway Avenue so any action for sidewalks on Ridgeway will be deferred until the study is completed. Staff is examining the possibility of sidewalks being required on Ansborough and Dixon. The nearest recreational trail is approximately one third of a mile to the west at the intersection of West Ridgeway Avenue and West 4th Street. ZONING HISTORY The area in question was rezoned from "R-4" Multiple FOR SITE AND Residence District to "R-4,C-Z" Conditional Zoning District on IMMEDIATE VICINITY: April 5, 2000 to allow for the use of the existing building to change from professional office to a financial institution.
