Officer Traffic Citation Board of Appeals
2-17-1: BOARD CREATED
There is hereby created an Officer Traffic Citation Board of Appeals. Hereinafter referred to in
this chapter as the "Board".
2-17-2: PURPOSE
The Board's purpose shall be to hold administrative appeal hearings in accordance with chapters
6-1-4 and 6-1-5 of this code.
2-17-3: COMPOSITION AND MEMBERSHIP
A. The board shall consist of three (3)members.
B. One (1)member shall be an employee of the Waterloo Police Department who has
achieved the rank of Lieutenant or higher.
C. One (1) member shall be a member of the Waterloo Human Rights Commission.
D. One (1) member shall be a resident of the City of Waterloo. The term of office of the
member of Human Rights Commission shall coincide with their term of office on said
board. The term of office for all other members shall be for a term of three (3)years. No
member of said board shall serve more than two (2) consecutive terms and shall not be
reappointed to a third term unless said member has not served on any board or
commission of the city for a minimum of one year before reappointment to any board or
commission; provided, however, that a third term may be approved upon extraordinary
circumstances and/or unavailability of applicants as determined by the mayor.
2-17-4: MEETINGS
A. The Board shall meet monthly or as deemed necessary by the Waterloo Chief of Police.
B. Three (3) members shall constitute a quorum of the Board.
C. Meeting location and time will be determined by the Waterloo Chief of Police.
D. All meetings of the board shall be held in accordance with Iowa Code chapter 21.
E. All records of the commission shall be in compliance with the requirements of Iowa Code
chapter 22.
2-17-5: POWERS AND DUTIES
A. The Board shall have the power to overturn citations issued in accordance with
subsections 6-1-4-E-1 and 6-1-5-F-1 of this code.
B. Overturning a citation shall require a unanimous vote by all three (3) Members.
