Prior to a vote on the above motion, the following comments were heard.
Councilperson Welper stated that the sale doesn't quite meet the city's property
guideline of sales, but that the Building and Grounds Committee is agreeing to
accept the curb cut as part of that development agreement. He stated that he
was fine with that as long as this is done for everyone. He would like to make
note that for now on curb cuts will be part of Building and Ground Committee
sale of land policy.

Prior to a vote on the above motion, the following comments were heard.
Mayor Hurley explained that we are more conscious about bidding because of
questions that have arose. He asked Sandie Greco, Superintendent of Traffic
Operations, if this was sent out for bid. Mrs. Greco responded that a list was
given to them from the Iowa Department of Transportation that included three in-
state and two out-of-state firms. Mrs. Greco stated that RFPs were sent out
that were approved and modified by the DOT. Mrs. Greco formed a selection
committee, which consisted of city personnel and INRCOG. Mayor Hurley explained
that the only one that replied was Hellman, Inc. The proposal was then reviewed
by the committee and sent to the DOT for their approval. The DOT pre -audited
Hellman, Inc. and then was finally given the contract. Mayor Hurley stated that
this is an extension of that action.
Following comments a vote was taken on the above motion with the following

ORAL PRESENTATIONS
130053 - Carmen Miller, 627 Sycamore Street, stated that she is concerned about the
proposed no parking from 2:00 a.m. to 8:00 a.m. in the downtown district. She
stated that some concerns have been brought up to the apartment complex. One
concern is the problem with the street plowing. Ms. Miller stated that she
lives downtown and loves living downtown. She understands that the city is
trying to draw more people into downtown and feels that this would deter from
people moving downtown if people are unable to park in front of their building
during the winter. She stated that she doesn't understand the harm of parking
along the street after 5:00 p.m. because most businesses are closed. The only
thing open along Sycamore is the Cigar Store and another store. Ms. Miller
stated that she started a petition and those owners also signed the petition.
She stated that she is in favor of plowing. She stated that another concern is
the disabled people in the building who have a hard time walking. She stated
during the winter with the conditions of the streets it will be easier for them
to get around when they are able to park up front. Mrs. Miller requested that
they be notified when the city will be plowing. She suggested that it be
announced on the television. She is willing to communicate with the city
regarding when the plowing is going to be. She stated that last year she
noticed that other cities advertised on the television. She stated that if
Sycamore Street is going to be plowed she would like to hear it on the news.
She feels that those that did not receive proper notification of the plowing of
Sycamore should first get a warning and then ticketed. She stated that she
feels that there are a lot more residents on the eastside then on the Westside
of downtown, and she does not feel like the residents should not be treated the
same as the Westside because they do not have an after bar place. She stated
that along the 600 block of Sycamore there are several residents that live above
in the apartments. She stated that her biggest concern is the safety.
Julie Baskerville, 627 Sycamore Street, asked where she is supposed to park.
She stated that she paid to park in the parking ramp and her vehicle has been
vandalized. She stated there are safety issues for parking downtown. She asked
if she is unable to park in front of the building, where would she park. She
stated that there is going to be plowing everywhere so where is everyone suppose
to park. She stated that it was daylight when her vehicle got broken into in
the ramp. She stated that it wasn't just hers, it was also five other cars in
the Waterloo Industry parking ramp. She stated that there are a lot of people
that live in that area that have cars. She asked where are they suppose to
park.
Ms. Miller stated that she feels it is a safety issue for those having to park
far away, being a single female, and people getting home at different times of
the night. She stated that another thing to consider is that there are bars
downtown. She stated that people do the responsible thing by leaving their cars
at the bar and calling for a taxi home. She stated if it is not a plowing
night, then they should have that option. If it is a plowing night, it has been
discussed, people are willing to help them move their vehicles to the parking
garage so that they can get home safely.
Mayor Hurley stated that there was a work session held four weeks ago with Main
Street. The whys behind it are basically what has been mentioned: the bars,
the increased amount of trouble, disturbance, etc. The snow plowing is another
issue. He stated that the downtown on -street metered parking was never really
designed for residential. He understands that we are inviting more people to be
residents. He stated that the status right now is it is in limbo. The city
learned some things listening to Main Street and they brought the same issues
up. This is going nowhere fast. It will be a very deliberate process as we
work through it.
Ms. Baskerville stated that when there are events downtown like Irish Fest, for
example, there is nowhere for the residents to park, and during the 4th of July
event people are not allowed to park in the parking ramps. She stated that then
the residents don't have a place to park when they get home and have to park 7
or 8 blocks away.

Ms. Miller stated that her main issue is the safety and winter time.
Mayor Hurley stated that he doubted that anything was going to change in the
near future. Mayor Hurley stated on the issue of snow plowing, we do have
routes and we do announce it. When there is a snow emergency, he stated for the
residents to get their car off the street. He stated that if there is going to
be three inches of snow or more, then to figure there is going to be a snow
emergency. He stated that the downtown area is plowed at night to avoid the
businesses.
Councilperson Getty asked about Park Avenue and Jefferson.
Mayor Hurley stated that there is no brick to lay and it is being manufactured
today and hopefully shipped by the end of the week. When the weather permits it
will be laid.
Councilperson Getty suggested that is it is not done to fill in with blacktop
until spring.
Mayor Hurley stated that Park Avenue is technically open and what the concern is
the turn lanes onto Jefferson. If we start to get heavy vehicles on the brick
without the support where there is a void of bricks right now, we will start
pushing bricks around and have the whole job to do over. He stated that he
doubts the contractor would let us do that without signing off.
Councilperson Getty asked to see the contract for the completion date and if
there are any penalties if its not done.
Councilperson Hart acknowledged the 100 years of NAACP existence. He stated
that there is a banquet this Saturday, October 17, 2009 at the Isle of Capri.
Mayor Hurley also acknowledged the 88th year that the Black Hawk Chapter NAACP
has been in existence and it's the 100th year of the National.
