RESOLUTION NO. 2018-670
RESOLUTION APPROVING A TEMPORARY
CONSTRUCTION EASEMENT AND DEDICATING A
SANITARY SEWER EASEMENT ON LAND OWNED BY THE
CITY OF WATERLOO, FOR THE BROCK SANITARY SEWER
MAIN EXTENSION, CONTRACT NO. 954, LOCATED NORTH
OF 1318 MARTIN ROAD.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA,
that the Resolution approving a Temporary Construction Easement Agreement dated September
4, 2018 with the City of Waterloo on land owned by the City of Waterloo, for the Brock Sanitary
Sewer Main Extension, Contract No. 954, located north of 1318 Martin Road, is hereby approved
and the Mayor and City Clerk are authorized and directed to execute all necessary documents on
behalf of the City of Waterloo, Iowa.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WATERLOO, IOWA that the following described property:
An Easement for Sanitary Sewer purposes over, under and across that part of the
Southeast Quarter (SE 1/4) of Section Thirty-two (32), Township Eighty-nine North
(T89N), Range Thirteen West (R13 W) of the Fifth Principal Meridian, in the City of
Waterloo, Black Hawk County, Iowa, described as follows:
Commencing at the Southeast corner of the Northeast Quarter (SE 1/4) of aforesaid
Southeast Quarter (SE 1/4); thence NO1°34'26"W Four Hundred Fifteen and Thirty-seven
Hundredths (415.37) feet along the East line of said Northeast Quarter (SE 1/4) of the
Southeast Quarter (SE 1/4); thence S88°25'34"W Forty (40.00) feet to the West right-of-
way line as per Land Deed 569, Page 604 in the Black Hawk County Recorder's Office
and to the point of beginning; thence continue S88°25'34"W Fifteen (15.00) feet; thence
N01°34'26"W Forty (40.00) feet; thence N88°25'34"E Fifteen (15.00) feet to aforesaid
West right-of-way line; thence SO 1°34'26"E Forty (40.00) feet along said West right-of-
way line to the point of beginning containing 606 square feet.
Along with a Temporary Construction Easement as shown on sheet 2 of 2 of this Plat.
be and the same is hereby dedicated for the purpose of construction and future maintenance of a
sanitary sewer line, generally located north of 1318 Martin Road in conjunction with the Brock
Sanitary Sewer Main Extension, Contract No. 954.
