ORDINANCE NO. 5465
AN ORDINANCE AMENDING ORDINANCE NO. 5079, AS AMENDED,
THE CITY OF WATERLOO ZONING ORDINANCE ADOPTED OCTOBER
17, 2011, BY:
REPEALING THE LAST SENTENCE OF SUBPARAGRAPH C OF
PARAGRAPH 4 OF SUBSECTION A, PRINCIPAL PERMITTED USES, OF
SECTION 10-14-1, REGULATIONS, OF CHAPTER 14, "C-1"
NEIGHBORHOOD COMMERCIAL DISTRICT; AND ENACTING IN LIEU
THEREOF A NEW LAST SENTENCE OF SAID SUBPARAGRAPH C, AND
REPEALING SUBSECTION D, USE RESTRICTIONS, OF SECTION 10-24A-
1, GENERAL REGULATIONS, OF CHAPTER 24A, ALCOHOL SALES USE
OVERLAY DISTRICTS; AND ENACTING IN LIEU THEREOF A NEW
SUBSECTION D, USE RESTRICTIONS, AND
INSERTING AN ADDITIONAL LEGAL DESCRIPTION AT THE END OF
THE EXISTING LEGAL DESCRIPTION FOR THE CHURCH ROW
NEIGHBORHOOD OVERLAY DISTRICT IN ATTACHMENT "A" TO
SECTION 10-24A-1, GENERAL REGULATIONS, OF CHAPTER 24A,
ALCOHOL SALES USE OVERLAY DISTRICTS, AND
REPEALING THE LAST SENTENCE OF SUBPARAGRAPH C OF
PARAGRAPH 2, PROHIBITED SIGNS, OF SUBSECTION C,
REGULATIONS OF ALL SIGNS, OF SECTION 10-26-1, OUTDOOR
ADVERTISING SIGNS AND BILLBOARDS, OF CHAPTER 26, OUTDOOR
ADVERTISING SIGNS AND BILLBOARDS; AND ENACTING IN LIEU
THEREOF A NEW LAST SENTENCE OF SAID SUBPARAGRAPH C.
BE IT ORDAINED by the City Council of the City of Waterloo that the City of Waterloo
Zoning Ordinance No. 5079, as previously amended, is amended as set out herein, repealing
those sections that are being replaced and setting forth the amendment or replacement sections,
and further amending said Ordinance by adding amendments as set out herein. Said Ordinance,
as amended hereby, shall apply to all lands lying within the corporate limits of the City of
Waterloo, Black Hawk County, Iowa. This Ordinance shall be in full force and effect after its
final passage and publication as provided by law.
BE IT ORDAINED by the City Council of the City of Waterloo, Iowa:
That the last sentence of Subparagraph c of Paragraph 4 of Subsection A, Principal
Permitted Uses, of Section 10-14-1, Regulations, of Chapter 14, "C-1" Neighborhood
Commercial District, is hereby repealed in its entirety; and that a new last sentence of said
Subparagraph c is hereby enacted in lieu thereof, as follows:
The limitations of this paragraph shall not apply to a grocery store in which the retail
floor space in the building equals or exceeds 15,000 square feet, or to a pharmacy.
That Subsection D, Use Restrictions, of Section 10-24A-1, General Regulations, of
Chapter 24A, Alcohol Sales Use Overlay Districts, is hereby repealed in its entirety; and that a
new Subsection D, Use Restrictions, is hereby enacted in lieu thereof, as follows:

D. Use Restrictions.
No new alcohol sales uses shall be established in an Alcohol Sales Use Overlay
District, other than (1) incidental alcohol sales uses, (2) a limited alcohol sales use
(on -premise consumption) that is a restaurant, or (3) a limited alcohol sales use (off -
premises consumption) that is (a) a grocery store in which the retail floor space in the
building equals or exceeds 15,000 square feet or (b) a pharmacy. Expansion of
alcohol sales uses other than those specifically identified above in this paragraph shall
be allowed only through approval by the Board of Adjustment process to expand a
legal non -conforming use.
That an additional legal description be inserted at the end of the existing legal description
for the Church Row Neighborhood Overlay District in Attachment "A" to Section 10-24A-1,
General Regulations, of Chapter 24A, Alcohol Sales Use Overlay Districts, as follows:
And also, beginning at the intersection of the centerlines of Williston Avenue and
Kimball Avenue; thence Southerly along the centerline of Kimball Avenue to its
intersection with the centerline of Carolina Avenue; thence Easterly along the
centerline of Carolina Avenue to its intersection with the centerline of Vermont
Street; thence Northerly along the centerline of Vermont Street to its intersection with
the centerline of Williston Avenue; thence Westerly along the centerline of Williston
Avenue to its intersection with the centerline of Kimball Avenue and the Point of
Beginning.
That the last sentence of Subparagraph c of Paragraph 2, Prohibited Signs, of Subsection
C, Regulations of All Signs, of Section 10-26-1, Outdoor Advertising Signs and Billboards, of
Chapter 26, Outdoor Advertising Signs and Billboards, is hereby repealed in its entirety; and that
a new last sentence of said Subparagraph c is hereby enacted in lieu thereof, as follows:
The limitations of this paragraph shall not apply to establishments located in the "C-
3" Commercial District, to any grocery store in which the retail floor space in the
building equals or exceeds 15,000 square feet, or to a pharmacy.

WATERLOO ZONING ORDINANCE OF
THE CITY OF WATERLOO, IOWA BY
AMENDING SELECTED CHAPTERS OF
TITLE 10, ZONING
This is a summary of amendments to
Ordinance No. 5079, as amended, the
Cityof Waterloo Zoning Ordinance
(reerred to below as the "Ordinance"),
which is set forth in Title 10 of the
Waterloo Code of Ordinances.
For grocery stores located in a "C-1"
Neighborhood Commercial District, loca-
ted in an alcohol sales use overlay
district, or classified as a limited alcohol
sales use, the amendments increase the
minimum retail floor space that a grocery
store must meet to qualify for exceptions
from use and signage requirements, from
10,000 square feet to 15,000 square feet.
The amendments also enlarged the area
of the Church Row Neighborhood Overlay
District, to include within such alcohol
sales use overlay district the additional
area described as follows: Beginning at
the intersection of the centerlines of
Williston Avenue and Kimball Avenue;
thence Southerly along the centerline of
Kimball Avenue to its intersection with the
centerline of Carolina Avenue; thence
Easterly along the centerline of Carolina
Avenue to its intersection with the
centerline of Vermont Street; thence
Northerly along the centerline of Vermont
Street to its intersection with the
centerline of Williston Avenue; thence
Westerly along the centerline of Williston
Avenue to its intersection with the
centerline of Kimball Avenue and the
point of beginning.
The above is only a summary of the
Ordinance amendments and not the
complete text of the Ordinance amend-
ments. There are other details and
specific terms, conditions, and require-
ments that have not been provided in this
summary. Questions should be directed

Ordinance amendments may be inspec-
ted in their entirety at the office of the City
Planner, 715 Mulberry Street, 2nd Floor,
Waterloo, Iowa 50703, from Monday
