RESOLUTION NO. 2019-53
RESOLUTION ACCEPTING WARRANTY DEED FROM BCS
PROPERTIES, LLC AND DEDICATING 2,180 SQUARE FEET
(0.05 ACRES) AS CITY OWNED RIGHT-OF-WAY, LOCATED
AT TIM NORTHWEST CORNER OF WEST RIDGEWAY
AVENUE AND FOUNDATION DRIVE.
WHEREAS, for consideration of One, ($1.00), BCS Properties, LLC has agreed to
convey by warranty deed, 2,180 square feet (0.05 acres) to the City of Waterloo, the following
described real estate in Black Hawk County, Iowa:
BEGINNING AT THE SOUTHEAST CORNER OF A CERTAIN PARCEL OF
LAND DESCRIBED AS LOT 1 OF VILLAGE WEST 2ND ADDITION AND
RECORDED IN INSTRUMENT NO. 2019-00005029 IN THE OFFICE OF THE
RECORDER, BLACK HAWK COUNTY, IOWA; THENCE, S89°06'08"W
10.00' ALONG THE SOUTH LINE OF SAID LOT 1; THENCE, N0°53'52"W
218.00' TO A POINT ON THE NORTH LINE OF SAID LOT 1; THENCE,
N89°06'08"E 10.00' ALONG SAID NORTH LINE TO THE NORTHEAST
CORNER OF SAID LOT 1; THENCE, S0°53'52"E 218.00' ALONG THE EAST
LINE OF SAID LOT 1 TO THE POINT OF BEGINNING, CONTAINING 2,180
SQ FT/ 0.05 ACRES. SUBJECT TO EASEMENTS AND RESTRICTIONS OF
RECORD, IF ANY.
generally located at the northwest corner of west ridgeway Avenue and Foundation Drive, and,
WHEREAS, said real estate will be used to dedicate an additional ten, (10) feet of City
right-of-way along the west side of Foundation Drive, east of where the new Casey's General
Store will be constructed.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the Warranty Deed from BCS Properties, LLC and dedicating 2,180
square feet (0.05 acres) as city owned right-of-way, located at the northwest corner of West
Ridgeway Avenue and Foundation Drive, is hereby accepted and approved.
