Getty Council Chambers, Waterloo, Iowa, at 5:30 p.m., on Monday, March 11, 2019. Mayor Quentin Hart in the Chair. Roll Call: Jacobs, Morrissey, Feuss, Klein, Amos, Schmitt, and Juon. Prayer or Moment of Silence. Pledge of Allegiance: Julie Dawson, Housing Authority Director 145954 - Juon/Schmitt that the Agenda, as proposed, for the Regular Session on Monday, March 11, 2019 at 5:30 p.m., be accepted and approved. Voice vote -Ayes: Seven. Motion carried. 145955 - Juon/Schmitt that the Minutes, as proposed, for the Regular Session on Monday, March 4, 2019 at 5:30 p.m., be accepted and approved. Proclamation Declaring April 7-13, 2019, as Crime Victims' Rights Week Recognition of the Waterloo East Pee Wee Wrestlers ORAL PRESENTATIONS Jim Chapman, 224 Bertch, commented that the city should do a study to see if one sided garbage pickup has been done or could be done. David Dryer, 3145 W. 4th Street, questioned how a budget can be set without having the contractual wage increases set. He questioned how effective the Chief of Police is as a Chief of Police when he is also serving as a County Supervisor. He further questioned what new knowledge the Mayor is bringing back from his travels to Washington, D.C. and Los Angeles. Randy Bennett, Public Works Manager, provided an update on snow removal efforts over the last few days. The goal is to try and get down to bare pavement in as many areas as possible by the end of the week. Crews have also been out trying to remove snow from storm sewers to help with flooding from rain and melting. Crews were also out working to address potholes today and will be out during the week to try to fill as many as possible. 145956 - Juon/Schmitt that the above oral comments be received and placed on file. RESOLUTIONS 145958 - Schmitt/Amos that "Resolution approving a Professional Services Agreement with Stanley Consultants, Inc., of Des Moines, Iowa, in an amount not to exceed $210,600, in conjunction with the Delane Avenue Detention Basin Design, and authorize the Mayor to execute said document", be adopted. Roll call vote -Ayes: Seven. Motion carried. Resolution adopted and upon approval by Mayor assigned No. 2019-139 145959 - Schmitt/Amos that "Resolution approving Addendum No. 2 to the Professional Services Agreement with Robinson Engineering Company of Independence, Iowa, in an amount not to exceed $2,300, in conjunction with the Westdale Subdivision Swale project, and authorize the Mayor to execute said document", be adopted. David Dryer, 3145 W. 4th Street, questioned if the bonds were already purchased for this purpose, and questioned how the bonds were going to be spent. Jamie Knutson, City Engineer, explained that the GO Bonds were sold one year ago for the project. He then provided an overview of the project. Resolution adopted and upon approval by Mayor assigned No. 2019-141 145961 - Morrissey/Amos that "Resolution authorizing the submission of an application to the Black Hawk County Metropolitan Area Transportation Policy Board for funding assistance from Iowa's Transportation Alternatives Program (TAP), in the amount of $458,800, with a City match of $114,700 funded from March 11, 2019 Page 4 G.O. Bonds, for the Cedar River Marina Recreational Trail Enhancements project", be adopted. Roll call vote -Ayes: Seven. Motion carried. Resolution adopted and upon approval by Mayor assigned No. 2019-142 145962 - Morrissey/Amos that "Resolution approving award of bid to Cedar Rapids Truck Center, Inc. of Cedar Rapids, Iowa for the purchase of one (1) automated side -load garbage truck in the amount of $237,790", be adopted. Resolution adopted and upon approval by Mayor assigned No. 2019-143 145963 - Amos/Morrissey that "Resolution approving award of bid to Stivers Ford of Waukee, Iowa for the purchase of one (1) 2019 small extended cab 4 X 4 short box pickup truck in the amount of $25,196", be adopted. Roll call vote -Ayes: Seven. Motion carried. Resolution adopted and upon approval by Mayor assigned No. 2019-144 145964 - Amos/Morrissey that "Resolution supporting the application by Black Hawk Contracting & Development Co. for the Iowa Workforce Housing Tax Incentives Program to construct four new single family homes, three homes located on Lots 2, 3 & 4 of Baltimore Field 1st Addition and one on the Easterly part of Lot 2 of Crossroads Estates Replat No 5 as Project Number 17-WHTIP-007 replacing previously approved Lots 1, 4, 5 & 6 of Hillside Addition, with a local match of the City Limits Urban Revitalization Area (CLURA) tax abatement for each property, and rescinding Resolution No. 2018-835.", be adopted. Resolution adopted and upon approval by Mayor assigned No. 2019-145 ORDINANCES 145965 - Morrissey/Feuss that "an Ordinance amending the City of Waterloo Code of Ordinances by amending Title 5, Police Regulations, by adding a new Chapter 6, Chronic Nuisance Vehicles", be received, placed on file, considered and passed for the third time and adopted. Roll call vote -Ayes: Seven. Motion carried. Jim Chapman, 224 Bertch, questioned if the ordinance will apply to the white line before the cross walks. Dan Trelka explained that red light violations would be one of the violations that this ordinance would tabulate for when a driver gets three violations to become a chronic nuisance vehicle. John Sherbon, 1715 Robin Road, stated that a lot of intersections require you to ignore the crosswalk if you want the visibility to turn right on red. David Dryer, 3145 W. 4th Street, stated that without taking chronic nuisance vehicles off the road the City is only pursuing a revenue stream, not public safety. Todd Obadal, 124 Amity Drive, expressed displeasure at the language of the ordinance, stating that due to its inability to fine corporations and municipalities, and the inability to target the owner of two or more vehicles who commit the same amount of infractions as single vehicle owners, it unfairly targets the average citizen of Waterloo. Mr. Schmitt requested clarification on why city employees would be exempt from the ordinance. Dan Trelka explained that in the case of a city employee warranting a fine in a city vehicle, the department head is notified and it is up to them to discipline their employees. March 11, 2019 Page 5 Mr. Schmitt questioned why specifically city vehicles are exempt from this ordinance. Dan Trelka explained it would be counterproductive and that in this case the City would be charging itself. Mr. Schmitt questioned which department drew up the ordinance, Police or Legal. Dan Trelka answered that he himself drew it up, mimicking the chronic nuisance property ordinance. Mr. Schmitt questioned if city employees are exempt from the chronic nuisance property ordinance, and questioned the logistics of notifying the employer of a city employee if someone else becomes Chief of Police. Dan Trelka answered that city employees are not exempt from that ordinance, and that they are not exempt from the chronic nuisance vehicle ordinance either, just that the punishment is left to the employer, also stating that the notification to employers is up to the new Chief of Police's discretion, but that he personally uses email as to leave a paper trail. Mrs. Klein commented that she has received a lot of communication about that portion of the ordinance, and expressed displeasure with the uneven and chaotic way that city employees may be punished for violating this ordinance. Mayor Hart asked for clarification on who receives the citation. Dan Trelka clarified that if the vehicle is registered to a citizen, the citizen receives the citation, and that if the vehicle is registered to the city the city could receive the citation if that's what council desires. Mrs. Juon questioned where the complaints came from, as she felt that the ordinance's language did not exclude any vehicle explicitly. Dan Trelka answered that the complaints probably originated from his comments during previous hearings. Mr. Amos commented that taxpayers own the vehicles, and that he felt the employer disciplining their employees was sufficient. Mr. Morrissey commented that a public employee would have a violation while driving a city vehicle reported to their boss, which could lead to termination and is a higher penalty than the public. Mrs. Klein commented that there should be uniformity for punishment when city employees break driving laws. Ordinance adopted and upon approval by Mayor assigned No. 5488.
