ORDINANCE NO. 4865 ORDINANCE AMENDING ORDINANCE NO. 2479, AS AMENDED, BY ADDING SUBSECTION NO. 112 TO SECTION 2A-7N, CONDITIONAL ZONING CERTAIN PROPERTY. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA: Section 1 . That Section 2A-7N, of Ordinance No. 2479, as amended, be further amended by adding after Subsection No. lll, of said Section, the following Subsection No. One Hundred Twelve (112) . "112 . That part of the Northwest '1, Section 23-88-13, City of Waterloo, Black Hawk County, Iowa, described as follows : Beginning at a point 1593 . 00 feet East and 40 . 00 feet South of the Northwest corner of said Section 23-88-13; thence South 00°00' 00" East a distance of 175 . 00 feet; thence South 90°00' 00" West a distance of 183 . 10 feet; thence North 00°00' 00" East a distance of 175 . 00 feet to a point 40 . 00 feet South of the North line of said Northwest i; thence North 90°00' 00" East a distance of 183 . 10 feet to the point of beginning. The North line of the Northwest 1,1 of Section 23-88-13 is assumed to bear North 90°00' 00" East, all in the City of Waterloo, Black Hawk County, Iowa; now zoned on the Zoning Map of Waterloo, Iowa, as "R-4, R-P" Planned Residence District, be and the same is hereby zoned as "C-1, C-Z" Conditional Commercial District as above described, subject to the following conditions : 1 . That the property shall be limited to the uses of the "C-1" Commercial District in addition to a 28-30 seat standard or fast food type restaurant, and; 2 . That any use of the property, including any restaurant, shall not include sale of any alcoholic beverages, and; 3 . That the exterior walls of any buildings on the property shall consist of brick, stone, or other similar masonry block design, and; 4 . That an effective visual barrier of landscaping plantings shall be provided and maintained along the entire east property, and that a 6-8 foot solid wood or solid vinyl fence shall be provided and maintained along the east side of the parking area, setback a minimum of 10 feet from the east property line, with the effective visual barrier landscaping plantings located between the fence and the property line, and; 5 . That any dumpster on the property shall include a closure with a solid wood or solid vinyl fence or masonry block on three sides with a gate on the fourth side, and; 7 \ , , % I Ordinance No. 4865 Page 2 6. That the dwelling currently addressed 1266 E. Orange Road shall be readdressed off of Stardust Drive, and; 7 . That the property shall be limited to access from Stardust Drive, with no access to be permitted from E. Orange Road, and; 8 . That a sidewalk shall be installed and maintained on the east side of Stardust Drive along the above described property. " Section 2 . That the City Clerk be, and she is hereby directed to file a certified copy of this Ordinance with the Recorder of Black Hawk County, Iowa.
