ORDINANCE NO. 4709 AN ORDINANCE AMENDING ORDINANCE NO. 2479, WATERLOO ZONING ORDINANCE, AS AMENDED, BY: REPEALING SECTION 2A-4 , CLASSIFICATION OF DISTRICTS, OF PART IV, DISTRICT AND BOUNDARIES; AND ENACTING IN LIEU THEREOF A NEW SECTION 2A-4, CLASSIFICATION OF DISTRICTS, OF PART IV, DISTRICT AND BOUNDARIES; AND ADDING SECTION 2A-6A, RIGHT OF WAY VACATION, TO PART IV, DISTRICT AND BOUNDARIES; AND REPEALING SUBSECTION (A) OF SECTION 2A-13 , LOT AREA, FRONTAGE AND YARD REQUIREMENTS, OF PART VII , "R-1" RESIDENCE DISTRICT; AND ENACTING IN LIEU THEREOF A NEW SUBSECTION (A) OF SECTION 2A-13 , LOT AREA, FRONTAGE AND YARD REQUIREMENTS, OF PART VII , "R-1" RESIDENCE DISTRICT; AND ADDING SUBSECTION (D) HEIGHT REGULATIONS, TO SECTION 2A-24 , REGULATIONS, OF PART XII, "C- 1" COMMERCIAL DISTRICT. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, as follows: That Section 2A-4 , Classification of Districts, of Part IV, District and Boundaries, of Ordinance No. 2479, Waterloo Zoning Ordinance, as amended, is hereby repealed in its entirety; that a new Section 2A-4 , Classification of Districts, of Part IV, District and Boundaries, of Ordinance No. 2479, Waterloo Zoning Ordinance, as amended, is hereby enacted in lieu thereof as follows : 2A-4 CLASSIFICATION OF DISTRICTS . In order to classify, regulate and restrict the location of trades and industries, and the location of buildings designed for specified uses, to regulate and limit the height and bulk of buildings hereafter erected or altered, to regulate and limit the intensity of the use of lot areas and to regulate and determine the area of yards, courts, and other open spaces within and surrounding such buildings, the City of Waterloo, Iowa, is hereby divided into sixteen (16) classes of districts . The use, height and area regulations are uniform in each class of district, and said districts shall be known as : Ordinance No. 4709 Page 2 "A-1" Agricultural District "R-R" Rural Residence District "R-1" One and Two Family Residence District "R-2" One and Two Family Residence District "R-3" Multiple Residence District "R-4" Multiple Residence District "S-1" Shopping Center "C-1" Commercial District "C-2" Commercial District "C-P" Planned Commercial District "B-P" Business Park District "C-3" Commercial District "M-1" Light Industrial District "M-2" Heavy Industrial District "M-2 , P" Planned Industrial District "R-P" Planned Residence District The "R-P" District is in conjunction with other Residential Districts, i .e . , R-1 (R-P) , R-2 (R-P) , R-3 (R-P) and R-4 (R-P) . That Section 2A-6A, Right of Way Vacation, of Part IV, District and Boundaries, of Ordinance No. 2479, Waterloo Zoning Ordinance, as amended, is hereby added as follows : 2A-6A RIGHT OF WAY VACATION. Whenever any street, road, alley or other public right of way is vacated by official action of City Council, the zoning district (s) adjoining each side of such public right of way shall be automatically extended to the center of such vacation and all area included in the vacation shall be subject to all appropriate regulations of the extended districts . Where only portions of public right of ways are vacated then the zoning district (s) adjoining the vacated portion shall be automatically extended over the entire area. That Subsection (A) of Section 2A-13 , Lot Area, Frontage and Yard Requirements, of Part VII, "R-1" Residence District, of Ordinance No. 2479, Waterloo Zoning Ordinance, as amended, is hereby repealed in its entirety; that a new Subsection (A) of Section 2A-13 , Lot Area, Frontage and Yard Requirements, of Part VII , "R-1" Residence District, of Ordinance No. 2479, Waterloo Zoning Ordinance, as amended, is hereby enacted in lieu thereof as follows : 2A-13 LOT AREA, FRONTAGE AND YARD REQUIREMENTS. A. This includes, but is not limited to, detached garages, sheds, all other accessory structures as well as the principal use. This requirement pertains to single family and two family homes exclusively. That Subsection (D) Height Regulations, of Section 2A- 24 ,Regulations, of Part XII , "C-1" Commercial District, of Ordinance No. 2479, Waterloo Zoning Ordinance, as amended, is hereby repealed in its entirety; that a new Subsection (D) Height Regulations, of Section 2A-24, Regulations, of Part XII, "C-i" Commercial District, of Ordinance No. 2479, Waterloo Zoning Ordinance, as amended, is hereby enacted in lieu thereof as follows : D. Height Regulations . No buildings shall exceed three (3) stories or forty- five (45) in height at the required front, side and rear yard lines, except two (2) feet may be added to the height permitted at said yard lines for each one (1) foot that the building or portion thereof is set back from the required yard lines and except as further provided in Section 2A-48 .
