ORDINANCE NO. 4743
AN ORDINANCE VACATING A UTILITY EASEMENT
GENERALLY LOCATED AT THE NORTHEAST CORNER OF
HAMMOND AVENUE AND SAN MARMAN DRIVE, JUST
SOUTH OF THE MENARD' S LUMBER YARD, IN THE
CITY OF WATERLOO, BLACK HAWK COUNTY, IOWA AND
RESCINDING ORDINANCE NO. 4691 IN ITS
ENTIRETY.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
as follows :
A storm sewer easement 20 feet in width, located in the
Southwest quarter of the Southwest quarter, of Section
2 , Township 88, Range 13 , West of the 5th Principal
Meridian, Waterloo, Black Hawk County, Iowa, described
as follows along the centerline of said easement;
Commencing at the Southwest corner of Southwest quarter
(SW 1/,) ; thence North 00°00' 00" East along the West line
of said Southwest 14; a distance of 751 . 92 feet; thence
North 90°00' 00" East a distance of 33 . 00 feet to the
East right-of-way line of Hammond Avenue which is also
the point of beginning; thence South 89°44 ' 54" East a
distance of 256 . 62 feet; thence South 41°49' 54" East a
distance of 381 . 11 feet to the Northwesterly right-of-
way of East San Marnan Drive, all in the City of
Waterloo, Black Hawk County, Iowa;
shall be, and the same is hereby vacated.

BE IT FURTHER RESOLVED that Ordinance No. 4691, be and the
same hereby rescinded in its entirety.
PASSED AND ADOPTED by the City Council of the City of
Waterloo, Iowa, on the 1st day of November, 2004, and approved by
the Mayor on the 3rd day of November, 2004 .
