ORDINANCE 'NO. 4751
ORDINANCE AMENDING ORDINANCE NO. 2479, AS
AMENDED, BY ADDING SUBSECTION NO. 106 TO
SECTION 2A-7N, CONDITIONAL ZONING CERTAIN
PROPERTY.
BE IT ORDAINED by the City Council of the City of Waterloo,
Iowa:
Section 1 . That Section 2A-7N, of Ordinance No. 2479, as
amended, be further amended by adding after Subsection No. 105,
of said Section, the following Subsection No. One Hundred Six
(106) .
"106.
Hollingsworth Addition Lot 33, all in the City of
Waterloo, Black Hawk County, Iowa;
now zoned on the Zoning Map of Waterloo, Iowa, as "R-2" One and
Two Family Residential District, be and the same is hereby zoned
as "R-2, C-Z" Residential/Conditional Zoning as above described,
subject to the following conditions :
1 . That the applicants will not seek state licensing
to operate as an assisted living facility.
2 . That care for no more than 6 individuals total,
with a maximum of two persons needing "hands on
care", will be administered.
3 . That there is to be no outside storage related to
the operation of the Boarding House.
4 . That residents, will not be allowed to have
vehicles at said Boarding and Lodging House.
5. That a detailed site plan be submitted and
approved by the Planning and Zoning Department.
6. That if the applicants discontinue the use as a
boarding and lodging house or sell the property,
that City staff will work to initiate the process
to rezone the property back to "R-2" One and Two
Family Residence District.
Section 2 . That the City Clerk be, and she is hereby
directed to file a certified copy of this Ordinance with the
Recorder of Black Hawk County, Iowa.
