ORDINANCE NO. 4770
AN ORDINANCE VACATING A PORTION OF RIGHT-OF-
WAY GENERALLY LOCATED AT THE SOUTHWEST CORNER
OF HEATH STREET AND U. S . HIGHWAY 63 TO ALLOW
DEVELOPMENT OF THE NEW HY-VEE GROCERY STORE
AND GAS STATION, IN THE CITY OF WATERLOO,
BLACK HAWK COUNTY, IOWA.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
as follows :
A part of the Southeast of Section 11-89-13,
Waterloo, Black Hawk County, Iowa, and a part of Lot 8,
Auditor Barnes' Plat No. 1, Waterloo, Black Hawk
County, Iowa, described as follows :
Beginning at the intersection of the Westerly right-of-
way line of U. S. 63 (Logan Avenue) and the Southerly
right-of-way line of Heath Street; thence South
14 °36' 00" West a distance of 46. 49 feet; thence South
00°30' 30" East a distance of 323. 59 feet to the
Southerly line of said Lot 8; thence North 89°33' 53"
East along the Southerly line of said Lot 8 a distance
of 27 . 00 feet to the Southeast corner of said Lot 8;
North 00°30' 30" West along the Easterly line of said
Lot 8 and its extension thereof a distance of 368 . 47
feet; thence South 89°29' 30" West a distance of 14 . 88
feet to the point of beginning.
The East line of said Lot 8 is assumed to bear South
00°30' 30" East, all in the City of Waterloo, Black Hawk
County, Iowa;
shall be, and the same is hereby vacated subject to city' s
retention of utilities easement over, under and above the above
described property.
