ORDINANCE NO. 4572
AN ORDINANCE AMENDING THE 2001 CODE OF
ORDINANCES OF THE CITY OF WATERLOO, IOWA, BY
REPEALING SUBSECTION 4-2-3 , NUISANCES
PROHIBITED, OF CHAPTER 2, NUISANCES, OF TITLE
4, PUBLIC HEALTH AND SAFETY; AND BY ENACTING
IN LIEU THEREOF A NEW SUBSECTION 4-2-3,
NUISANCES PROHIBITED, OF CHAPTER 2, NUISANCES,
OF TITLE 4, PUBLIC HEALTH AND SAFETY.
BE IT ORDAINED by the City Council of the City of Waterloo,
Iowa:
That Subsection 4-2-3 , Nuisances Prohibited, of Chapter 2 ,
Nuisances, of Title 4 , Public Health and Safety, of the 2001
Code of Ordinances of the City of Waterloo, Iowa, is hereby
repealed in its entirety; that a new Subsection 4-2-3 , Nuisances
Prohibited, of Chapter 2 , Nuisances, of Title 4 , Public Health
and Safety, of the 2001 Code of Ordinances of the City of
Waterloo, Iowa, is hereby enacted in lieu thereof as follows :
4-2-3 : NUISANCES PROHIBITED:
If judgment is entered against any person for erecting,
causing, or continuing a nuisance as defined in this
ordinance, the person shall be deemed to have committed a
municipal infraction and upon conviction thereof shall be
punished as provided in the general penalty at 1-3-2 and
any amendments thereto, and the court, in addition to the
civil penalty, may order any alternative relief to abate
the nuisance .
