AN ORDINANCE AMENDING WATERLOO ZONING
ORDINANCE NO. 2479, AS AMENDED, BY REPEALING
SUBSECTION (1) OF SUBSECTION A, PRINCIPAL
PERMITTED USES, OF 2A-33 , REGULATIONS, OF
PART XV, "M-1" LIGHT INDUSTRIAL DISTRICT,
AND SUBSECTION (2) OF SUBSECTION A,
PRINCIPAL PERMITTED USES, OF 2A-37,
REGULATIONS, OF PART XVI, "M-2" HEAVY
INDUSTRIAL DISTRICT; AND ENACTING IN LIEU
THEREOF NEW SUBSECTION (1) OF SUBSECTION A,
PRINCIPAL PERMITTED USES, OF 2A-33 ,
REGULATIONS, OF PART XV, "M-1" LIGHT
INDUSTRIAL DISTRICT, AND SUBSECTION (2) OF
SUBSECTION A, PRINCIPAL PERMITTED USES, OF
2A-37, REGULATIONS, OF PART XVI , "M-2" HEAVY
INDUSTRIAL DISTRICT [ALLOWING REBUILD OF
LEGALLY ESTABLISHED HOMES] .
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO,
IOWA:
Subsection (1) of Subsection A, Principal Permitted Uses,
of 2A-33 , Regulations, of Part XV, "M-1" Light Industrial
District, of Zoning Ordinance No. 2479, is hereby repealed in
its entirety; that new Subsection (1) of Subsection A, Principal
Permitted Uses, of 2A-33 , Regulations, of Part XV, "M-1" Light
Industrial District, of Zoning Ordinance No. 2479, is hereby
enacted in lieu thereof as follows :
PART XV
"M-1" LIGHT INDUSTRIAL DISTRICT
2A-33 REGULATIONS.
The regulations set forth in this part and contained in Part V
shall apply in the "M-1" Light Industrial District .
A. Principal Permitted Uses
1 . Any use permitted in the "C-3" District, except that
no occupancy permit shall be issued for any school,
hospital , clinic, or other institution for human care,
or new dwelling except where physically attached and a
part of another permitted use . This restriction
shall apply to new dwellings only, and shall not
prohibit the rehabilitation, reconstruction, or
rebuilding of dwellings in industrial districts that
were legally built prior to adoption of this
ordinance . Furthermore, any such legally established
dwelling may be rebuilt, if damaged or destroyed, on
the same lot as legally established, provided that all
other rules and regulations of this Ordinance are met .
For the purposes of this ordinance, any such legally
established dwelling is not considered a non-
conforming use as defined herein, but is considered a
legal use as described in this paragraph.

Subsection (2) of Subsection A, Principal Permitted Uses,
of 2A-37, Regulations, of Part XVI , "M-2" Heavy Industrial
District, of Zoning Ordinance No. 2479, is hereby repealed in
its entirety; that new Subsection (2) of Subsection A, Principal
Permitted Uses, of 2A-37, Regulations, of Part XVI , "M-2" Heavy
Industrial District, of Zoning Ordinance No. 2479, is hereby
enacted in lieu thereof as follows :
PART XVI
"M-2" HEAVY INDUSTRIAL DISTRICT
2A-37 REGULATIONS.
The regulations set forth in this part and contained in Part V
shall apply in the "M-2" Heavy Industrial District .
A. Principal Permitted Uses.
A building or premises may be used for any purpose
whatsoever except those listed in subparagraph 1, 2 and 3
below:
1 . No occupancy permit shall be issued for any use in
conflict with any ordinance of the City of Waterloo or
law of the State of Iowa regulating nuisances .
2 . No occupancy permit shall be issued for any dwelling,
school, hospital, clinic, or other institution for
human care, except where physically attached and a
part of another permitted principal use . The
provisions of 2A-33 (Al) shall apply in regards to
dwellings legally established prior to adoption of
this ordinance.
PASSED AND ADOPTED by the City Council on this 5th day of
May, 2003 , and approved by the Mayor on this 7th day of May,
2003 .
