ORDINANCE NO. 4666
AN ORDINANCE AMENDING THE 2003 TRAFFIC CODE
BY REPEALING SECTIONS 177, PASSING ON THE
RIGHT SIDE, AND 178, OVERTAKING AND PASSING A
VEHICLE WITH UNOBSTRUCTED PAVEMENT OF
SUFFICIENT WIDTH FOR FOUR OR MORE LANES; AND
ENACTING IN LIEU THEREOF NEW SECTIONS 177,
PASSING ON THE RIGHT SIDE, AND 178,
OVERTAKING AND PASSING A VEHICLE WITH
UNOBSTRUCTED PAVEMENT OF SUFFICIENT WIDTH FOR
FOUR OR MORE LANES .
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
That Sections 177, Passing on the Right, and 178, Overtaking
and Passing a Vehicle with Unobstructed Pavement of Sufficient
Width for Four or More Lanes, of the 2003 Traffic Code, are
hereby repealed in their entirety; that new Sections 177, Passing
on the Right, and 178, Overtaking and Passing a Vehicle with
Unobstructed Pavement of Sufficient Width for Four or More Lanes,
of the 2003 Traffic Code, are hereby enacted in lieu thereof as
follows :
SECTION 177 . PASSING ON THE RIGHT SIDE.
Unless otherwise prohibited by law, the driver of a vehicle
on a roadway with unobstructed pavement of sufficient width for
two or more lanes of traffic moving in the same direction as the
vehicle being passed may overtake and pass upon the right of
another vehicle which is making or about to make a left turn when
such movement can be made in safety. The scheduled fine is
$100 . 00 .
SECTION 178 . OVERTAKING AND PASSING A VEHICLE WITH
UNOBSTRUCTED PAVEMENT OF SUFFICIENT WIDTH FOR FOUR OR MORE
LANES .
Unless otherwise prohibited by law, the driver of a vehicle
may overtake and, allowing sufficient clearance, pass another
vehicle proceeding in the same direction either upon the left or
upon the right on a roadway with unobstructed pavement of
sufficient width for four or more lanes of moving traffic when
such movement can be made in safety. The driver of a vehicle
shall not drive off the pavement or upon the shoulder of the
roadway or upon the apron or roadway of an intersecting roadway
in overtaking or passing on the right or the left . The scheduled
fine is $100 . 00 .
