ORDINANCE NO. 4694
ORDINANCE AMENDING ORDINANCE NO. 2479, AS
AMENDED, BY ADDING SUBSECTION NO. 358 TO
SECTION 2A-5, REZONING CERTAIN PROPERTY.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
Section 1 . That Section 2A-5, of Ordinance No. 2479, as
amended, be further amended by adding after Subsection No. 357,
of said Section, the following Subsection No. Three Hundred Fifty
Eight (358) .
"358 .
Parcel "B" of Plat of Survey Document #2004-02509 as
described as follows : That part of the West half of
the Southeast quarter (W % SE 1/) of Section No. 21,
Township No. 89 North, Range No. 12 West of the Fifth
Principal Meridian, Black Hawk County, Iowa, described
as follows :
Commencing at the Southwest corner of the Southeast 1/
of said Section No. 21, point being a found "mag" nail
in A.C.C. pavement; thence due East along the South
line of said Southeast quarter a distance of 499 . 8 feet
to the point of beginning, being a set "mag" nail in
A.C.C. pavement; thence due North a distance of 369 . 0
feet to a set %" rebar with license #6505; thence due
East a distance of 195 . 0 feet to a set %" rebar with
license #6505; thence due South a distance of 369 . 0
feet to the South line of said Southeast quarter, point
being a set "mag" nail in A.C.C. pavement; thence due
West along said South line a distance of 195 . 0 feet to
the point of beginning.
Containing 1 . 65 acres including 0 . 15 acre of right-of-
way. Subject to easements of record and not of record.
The South line of the Southeast quarter of said Section
No. 21 is assumed to bear due East for this
description, all in the City of Waterloo, Black Hawk
County, Iowa;
And also,
The West of the Southeast 1/ of Section 21, Township
89 North, Range 12 West of the 5th Principal Meridian,
County of Black Hawk, State of Iowa, except that part
described as follows : Beginning at the Southeast
corner of the West % of the Southeast 1/ of said Section
21; thence North 01° (degrees) 31' (minutes) 50"
(seconds) East on the East line of the West % of the
Southeast 1/ of said Section 21, a distance of 693 . 00
feet; thence North 87°40 ' 37" West on a line that is
parallel with the South line of the West % of the
Southeast 1/ of said Section 21, a distance of 332 . 00
feet; thence South 01°31' 50" West, 693 . 00 feet to a
point on the South line of the West % of the Southeast
1/ of said Section 21 which is 332 . 00 feet West of the
point of beginning; thence South 87°40' 37" East on the
South line of the West % of the Southeast 1/ of said
Section 21, a distance of 332 . 00 feet to the point of
beginning; and also excepting Parcel "B" of Plat of
Ordinance No. 4694

Survey Document #2004-02509 and also except that part
conveyed to the City of Waterloo, Iowa, for Martin
Luther King, Jr. Drive, recorded in Land Deed Book 571
Page 808 in the Black Hawk County Recorder' s office .
Subject to easements of record.
The South line of the West of the Southeast 1/ of said
Section 21 is assumed to bear North 87°40' 37" West for
the purpose of this description.
Containing 63 . 82 acres including 0 . 75 acre of right-of-
way for Independence Avenue .
The above parcel of land is the same lands conveyed by
the estate of Audrie B. King, deceased, to the Willard
R. Frost Trust by Court Order Deed, recorded in Fee
Book 2004-15274 , in the Black Hawk County Recorder' s
office, all in the City of Waterloo, Black Hawk County,
Iowa;
now zoned on the Zoning Map of Waterloo, Iowa, as "A-1"
Agricultural District, be and the same is hereby zoned as "M-2 , P"
Planned Industrial District as above described.
Section 2 . That the City Clerk be, and she is hereby
directed to file a certified copy of this Ordinance with the
Recorder of Black Hawk County, Iowa.
