AN ORDINANCE AMENDING THE CODE OF ORDINANCES
OF THE CITY OF WATERLOO, IOWA, BY: REPEALING
SECTION 14-12 , VIOLATION AND PENALTY, OF
ARTICLE I , IN GENERAL, OF CHAPTER 14 , FIRE
PREVENTION AND PROTECTION; AND ENACTING IN
LIEU THEREOF A NEW SECTION 14-12 , VIOLATION
AND PENALTY, OF ARTICLE I, IN GENERAL, OF
CHAPTER 14, FIRE PREVENTION AND PROTECTION;
AND REPEALING SECTION 14-51, ANNUAL
INSPECTIONS, AND SUBSECTION (a) OF SECTION
14-58, PERMITS AND CERTIFICATES REQUIRED, OF
ARTICLE III , FIRE PREVENTION INSPECTIONS, OF
CHAPTER 14 , FIRE PREVENTION AND PROTECTION;
AND ENACTING IN LIEU THEREOF A NEW SECTION
14-51, ANNUAL INSPECTIONS, AND SUBSECTION (a)
OF SECTION 14-58, PERMITS AND CERTIFICATES
REQUIRED, OF ARTICLE III , FIRE PREVENTION
INSPECTIONS, OF CHAPTER 14 , FIRE PREVENTION
AND PROTECTION.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WATERLOO,
IOWA:
That Section 14-12 , Violation and Penalty, of Article I , In
General, of Chapter 14 , Fire Prevention and Protection of the
Code of Ordinances of the City of Waterloo, Iowa, is hereby
repealed in its entirety; that a new Section 14-12 , Violation
and Penalty, of Article I , In General , of Chapter 14 , Fire
Prevention and Protection of the Code of Ordinances of the City
of Waterloo, Iowa, hereby enacted in lieu thereof as follows :
Sec . 14-12 . Violation and penalty.
The civil penalty for a municipal infraction shall be
scheduled as follows :
First offense, two hundred dollars ($200 . 00) ;
Second offense, five hundred ($500 . 00) ; and
Third or more offense, seven hundred fifty dollars
($750 . 00) .
All such persons shall be required to correct or remedy
such violations or defects within a reasonable time, and when
not otherwise specified, the application of the above penalty
shall not be held to prevent the enforced removal of prohibited
conditions .
That Section 14-51, Annual Inspections, and Subsection (a)
of Section 14-58, Permits and Certificates Required, of Article
III , Fire Prevention Inspections, of Chapter 14 , Fire Prevention
and Protection, of the Code of Ordinances of the City of
Waterloo, Iowa, are hereby repealed in their entirety; that new
Section 14-51, Annual Inspections, and Subsection (a) of Section
14-58, Permits and Certificates Required, of Article III, Fire
Prevention Inspections, of Chapter 14 , Fire Prevention and

Protection, of the Code of Ordinances of the City of Waterloo,
Iowa, are hereby enacted in lieu thereof as follows :
Sec . 14-51 . Annual inspections .
The fire marshal shall inspect or cause to be inspected all
premises on an annual basis, and shall make such orders as may
be necessary for the enforcement of the laws and ordinances
governing the same and for safeguarding of life and property
from fire . A property owner or any other person having charge,
care, or control of any premises shall, upon demand for entry
and presentation of credentials by the fire marshal , fire
inspectors, or fire officers, allow the fire marshal , fire
inspectors, or fire officers access and entry to the premises
for purposes of inspection. Denial of entry, or interference
with the inspection by any person, shall constitute a municipal
infraction punishable pursuant to Section 14-12 .
Sec . 14-58 . Permits and certificates required.
(a) Inspection certificate required. An annual fire
prevention inspection certificate is required for all structures
except residential . Fees for this certificate shall be as set
forth in Section 14-60 . Failure to obtain a certificate shall
constitute a municipal infraction punishable pursuant to Section
14-12 .
