ORDINANCE NO. 4530 AN ORDINANCE AMENDING THE 2001 CODE OF ORDINANCES OF THE CITY OF WATERLOO, IOWA, BY REPEALING ARTICLE F, HOUSING AUTHORITY, OF CHAPTER 6, MUNICIPAL DEPARTMENTS, OF TITLE 1, ADMINISTRATION; AND ENACTING IN LIEU THEREFORE A NEW CHAPTER 14 , HOUSING AUTHORITY BOARD, OF TITLE 2 , BOARDS AND COMMISSIONS . BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA; That Article F, Housing Authority, of Chapter 6, Municipal Departments, of Title 1, Administration, of the 2001 Code of Ordinances of the City of Waterloo, Iowa, is hereby repealed in its entirety; that a new Chapter 14 , Housing Authority Board, of Title 2 , Boards and Commissions, of the 2001 Code of Ordinances of the City of Waterloo, Iowa, is hereby enacted in lieu thereof as follows : CHAPTER 14 HOUSING AUTHORITY BOARD 2-14-1 : HOUSING AUTHORITY CREATED The Housing Authority Board (hereinafter the "Board" ) of the City of Waterloo is hereby created. 2-14-2 : COMPOSITION AND MEMBERSHIP A. Composition: The Board shall consist of one resident from each the Section 8 and Public Housing programs : and all members of the City Council for a total of nine (9) Board members . The two (2) members from the Public Housing Authority (PHA residents) shall be appointed by the Mayor subject to approval of a majority of the City Council . B. Term of Office : Resident members of the Section 8 and Public Housing Program shall serve two-year terms . No resident member of said Board shall serve more than two (2) consecutive terms and shall not be reappointed to a third term unless the member has not served on any Board or Commission of the city for a minimum of one year before he/she is reappointed to any Board or Commission. C. Filling Vacancies : If any member from the Board shall leave for any reason, the Mayor shall appoint a successor subject to approval of the City Council . D. Compensation: All members of the Board shall serve without compensation except for their actual expenses, which shall be subject to approval of a majority of the Board. Ordinance No. 4530 Page 2 E . Organization: The Waterloo Housing Authority shall annually elect, at its first regular meeting held in the month of July, one of its members to act as Chair of the Board, and another member as vice chair, who shall perform all of the duties of the chair during her/his absence, and a third (3rd) member as secretary. F. Rules And Regulations : The Board shall adopt such rules and regulations governing its organization and procedures, as may be required by local , state and federal laws . G. Committees : The Board may establish any committee deemed necessary for the execution of its powers or duties as permitted by local, state and federal laws . H. Unexcused Absences : Any Board member who misses more than three (3) Consecutive meetings without a legitimate excuse may be recommended by the executive committee (chair, vice chair and secretary) to the Mayor for removal . 2-14-3 : POWERS AND DUTIES It shall be the duty of the Board to provide and coordinate the federally subsidized public housing programs . All powers and responsibilities, including the signatory authority of the Annual Contributions Contract shall vest with the Board. Actions taken by the Board shall be final and not subject to administrative review. The Board shall implement policies to effect its duties . 2-14-4 : APPROPRIATIONS The Board shall have full , complete and exclusive authority to make decisions relating to the administration, operation, operating budget (including salaries and wages) , and management of federal public housing programs and Section 8 tenant based rental assistance programs and to expend for and on behalf of such Public Housing Authority all sums of money so appropriated. All such expenditures shall be made pursuant to and in conformance with the Board' s established policies and procedures . The Board shall have no power to contract debts beyond its budget set for the fiscal year in which the debt is to be paid. 2-14- 5 : HOUSING DIRECTOR A. Appointment : A Housing Director shall be appointed by the City Planner and subject to approval of a majority of the Board. Such appointment shall be in accordance with all city policies and procedures as to recruitment, selection, and appointment of employees . However, the Housing Director shall not be subject to civil service laws . B. Absence of Housing Director: Whenever the Housing Director shall be out of the city, or unable to act for any reason (including those periods of time when the City Planner has Ordinance No. 4530 Page 3 not appointed a Housing Director) , the City Planner may appoint a designee who may exercise all powers and duties of the Housing Director. C. Management, Supervision And Duties : The Housing Director shall supervise, direct and manage the Housing Authority. The Director' s duties shall be as follows : 1 . To promulgate orders, rules and regulations for the conduct and guidance of the members of the Housing Authority within the parameters of city policy; 2 . To make an annual report of the activities of the Housing Authority for each year, and which shall be filed with the Board; 3 . To hire, train and assign the personnel of the Housing Authority as deemed necessary to carry out the functions of the Housing Authority, and to prescribe rules and regulations for the conduct and management of the department consistent with the city' s policies; 4 . To discipline, suspend or discharge any subordinate under her/his direction for just cause pursuant to city policy, or in accordance with applicable laws; 5 . To perform or cause to be performed any other duties as directed by the City Planner and which is permitted by local, state or federal laws; 6 . To actively investigate, procure and manage those newly authorized housing programs available through federal or state grants and contracts deemed by the Housing Authority to be in the best interest of the city; 7 . To supervise and manage the city' s housing programs including the Section 8 existing housing certificates program, Section 8 housing voucher program, public housing development, modernization and management, and others as they become available; 8 . To administer the Housing Authority' s programs, prepare policies and budgets for approval by the Board where required, assign staff, determine schedules and review progress on the programs; 9 .To supervise and coordinate development and implementation of the city' s public housing programs in cooperation with other departments and agencies to the mutual advantage of the housing programs and the city; 10 .To act as technical advisor on public housing management and development matters to the Board or other committees designated by the Board to appear, in person or by her/his designee before the City Council to report or advise on housing matters and housing development/management techniques being utilized in other communities; nn�r .An?a�r CAV Ordinance No. 4530 Page 4 11 .To coordinate and review work performed by professionals and contractors retained by the Housing Authority to perform services, construction or studies as required by the Housing Authority; 12 .To work with federal , state and adjoining local governments in implementing the Waterloo Housing Authority' s programs; 13 .To perform other duties necessary to carry out the purposes of the Section 8/Public Housing Program and any other housing programs of the City of Waterloo.
