AN ORDINANCE AMENDING THE 1993 CODE OF
ORDINANCES OF THE CITY OF WATERLOO, IOWA, BY
ADDING SECTION 19-29, POSTING OF SIGNS
INDICATING SUBSTANDARD HOUSING, OF CHAPTER
19, HOUSING.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WATERLOO,
IOWA, as follows :
That Section 19-29, Posting of Signs Indicating Substandard
Housing, of Chapter 19, Housing, is hereby enacted as follows :
Sec. 19-29. Posting of Signs Indicating Substandard Housing
(a) The following definitions shall apply for purposes of this
Section 19-29 .
(1) A "Housing Inspector" is an officer functioning under
the authority of the Fire Chief who performs
inspections of all buildings or portions thereof that
are used, or designed or intended to be used, for human
habitation to ensure compliance of such buildings with
the Housing Code.
(2) "Substandard property" is any property that the Fire
Chief finds to be in substantial violation of the
Housing Code .
(3) An "owner of record" is the legal title holder of the
property as shown by documents on file at the office of
the Black Hawk County Recorder, or any person or entity
utilizing a trade name, fictitious business name, or
assumed name through which the legal title holder
transacts business.
(4) A "Holder of an interest" is any person or entity
owning, directly or indirectly, a beneficial interest
in at least 10 percent of the total ownership interest
of an owner of record as shown by documents on file at
the office of the Housing Inspector or Fire Chief as
shown on application for rental property licensing.
(b) Notice to owner of record.
Upon determination that a property is a substandard property,
the Fire Chief shall notify the owner of record of the
property of the defects . In the discretion of the Fire
Chief, said notice may also be delivered to the holder or any
of the deedholders . The notice may require the owner of
record of the property or the holder of an interest to
complete the required repairs, improvements, or cleanup
within 30 days, or such longer time as the Fire Chief may
state in the notice. The notice may require that any
building or part thereof be vacated within the time stated
and not reoccupied until the required repairs, improvements,
or cleanup have been completed, inspected, and approved by
the Fire Chief .
(c) Service of notice.
Service of notice described in Section 19-29 shall be by
personal service or by certified mail to the owner of record
or the holder of an interest at his or her last-known address
as recorded at the Treasurer of Black Hawk County. When
contact cannot be made at the last-known address, service
shall be accomplished by posting a copy of the notice in a
conspicuous place upon the substandard property. Said notice

shall be dated and signed by the official posting it .
The period designated in the notice within which the owner of
record or holder of an interest must comply shall commence as
of the date said person is personally served or the date said
which ever first occurs and person receives the notice by
certified mail or first refuses to receive the notice by
certified mail . If service is made by posting, the
compliance period shall begin seven days following the date
of posting.
(d) Posting of sign indicating noncompliance.
If the defect stated in the notice have not been corrected,
inspected, and approved within the period designated in the
notice and no longer period has been allowed by the Fire
Chief, the Fire Chief may cause to be posted as set out in
this ordinance a sign reading substantially as follows :
SUBSTANDARD PROPERTY. THE OWNER (name and address
as shown by the tax records of the Black Hawk
County Treasurer) HAS NOT MAINTAINED THIS
PROPERTY, AND IS THEREFORE, IN VIOLATION OF THE
WATERLOO HOUSING CODE.
Said sign shall contain such additional warnings or
information as, in the opinion of the Fire Chief, are
expedient .
Said sign shall be posted on the property within the city
right-of-way, or within the city right-of-way as close to the
property as is possible . Said sign shall remain posted until
the required repairs, improvements, or cleanup have been
completed, inspected, and approved by the Fire Chief, or
until an agreement has been reached between the City and the
owner of record or holder of an interest to correct such
violations by a specified date all at City' s discretion.
(e) Unauthorized removal of sign.
Removal of the sign described in Section 19-29, Sub. Sec. 4
without the authorization of the Fire Chief is a municipal
infraction and shall be punished accordingly.
