ORDINANCE AMENDING ORDINANCE NO. 2479, AS
AMENDED, BY ADDING SUBSECTION NO. 85 TO
SECTION 2A-7N, REZONING CERTAIN PROPERTY.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
Section 1 . That Section 2A-7N, of Ordinance No. 2479, as
amended, be further amended by adding after Subsection No. 84, of
said Section, the following Subsection No. Eighty-Five (85) .
"85 .
Lot 13 and 14 Block One (1) Leavitts Addition in the
City of Waterloo, Black Hawk County, Iowa excepting
that part of Lot 13 described as within the following
boundaries : commencing at the Northeasterly line of the
alley in said Block 1, 62 . 5 feet Northwesterly from the
Southwesterly corner of Lot 12 in Block 1; thence
Northeasterly to a point on the Southeasterly line of
Wellington Street, 82 1/3 feet Northwesterly from the
Southeasterly corner of said Lot 12 ; thence
Southeasterly along the Southwest line of Wellington
Street to the Southeasterly line of Lot 13 to the
Southwesterly corner of said Lot 13 ; thence
Northwesterly to the place of beginning; and
Beginning at the Southwesterly corner of Lot 14 which
intersects the Southerly R-O-W of West 4th Street and
said vacated alley; thence S 56°03 ' 27" E 135 .41 feet
along the Northerly line of said vacated alley; thence
S 86°22 ' 36" W 103 . 11 feet along the Northerly line of
relocated West 5th Street; thence Southeasterly 52 . 20
feet along a 612 . 96 foot radius curve concave Easterly,
the long chord of which bears N 07°47 ' 26" E 52 .44 feet
along said Southerly line of West 4th Street to the
point of beginning, all in the City of Waterloo, Black
Hawk County, Iowa;
now zoned on the Zoning Map of Waterloo, Iowa, as "R-4" Multiple
Residence District, be and the same is hereby zoned as "C-l/C-Z"
Conditional Zoning as above described subject to the following
conditions : "
1 . Limited to 350 sq. ft . site plan as submitted.
2 . No liquor or alcohol served by restaurant .
3 . Hours of operation 10 : 00 a.m. to 10 : 00 p.m.
Monday-Saturday and 12 : 00 p.m. (Noon) to 10 : 00
p.m. Sunday.
4 . Lease Agreement approval by the Board of
Adjustment and recording of lease at Black Hawk
County Recorder' s Office.
5 . A sign limitation of 1 sq. ft . to deter drive-in
traffic.
6 . Submission of a detailed parking plan by property
owner with drainage and landscaping shown.
Section 2 . That the City Clerk be, and she is hereby
directed to file a certified copy of this Ordinance with the
Recorder of Black Hawk County, Iowa.
