ORDINANCE NO. 4341
AN ORDINANCE AMENDING THE CODE OF ORDINANCES
OF THE CITY OF WATERLOO, IOWA, BY REPEALING
ARTICLE II , RECREATION, OF CHAPTER 28 , PARKS
AND RECREATION, AND ENACTING IN LIEU THEREOF
A NEW ARTICLE II , CULTURAL AND ARTS
COMMISSION, OF CHAPTER 28, LEISURE, CULTURAL
AND ARTS SERVICES .
That Article II, Recreation, of Chapter 28 , Parks and Recreation,
of the Code of Ordinances of the City of Waterloo, Iowa, is
hereby repealed in its entirety; that a new Article II , Cultural
and Arts Commission, of Chapter 28, Leisure, Cultural and Arts
Services, is hereby enacted in lieu thereof as follows :
ARTICLE II . CULTURAL AND ARTS COMMISSION.
DIVISION 1. GENERALLY
Sec . 28-12 . Establishment of Cultural and Arts Commission.
There shall be established a Cultural and Arts Commission
responsible to provide opportunities in the arts, in the broadest
sense, to enhance the quality of life of the citizens of
Waterloo, Iowa.
DIVISION 2 . CULTURAL AND ARTS COMMISSIONERS
Sec . 28-18 . Composition; appointment, initial and regular
terms of members; organization.
(a) The Cultural and Arts Commission shall consist of seven
(7) members to be appointed by the mayor with the approval of the
council . Three (3) of the members' terms shall expire March 1 ,
2000; two (2) of the members' terms shall expire March 1 , 2001 ;
and two (2) of the members' terms shall expire March 1 , 2002 . No
member of the Commission shall serve more than two (2)
consecutive terms and shall not be reappointed to a third term
unless the member has not served on any board or commission of
the City for a minimum of one (1) year before reappointment to
any board or commission; except a third term may be approved upon
extraordinary circumstances and unavailability of applicants as
determined by the Mayor.
(b) At its first meeting, the Cultural and Arts
Commissioners shall elect a chairperson and vice-chairperson, who
shall serve for a one (1) year term. The chair shall decide on
all points of order and procedure unless otherwise directed by a
majority of the Commissioners in session at the time . The chair
shall appoint any standing or temporary committees necessary to
carry out the function of the Commission.

(c) By the second Monday in September, the mayor with the
approval of the council, shall appoint commissioners to succeed
commissioners retiring on the following first day of October, who
shall hold office as set out in this ordinance . The
commissioners shall hold their office until their successors are
appointed and qualified.
Sec . 28-19 . Persons eligible for membership.
Qualified electors of the city are eligible for appointment
to the Cultural and Arts Commission.
Sec. 28-20 . Compensation of members.
Members of the Cultural and Arts Commission shall receive no
compensation for their services .
Sec. 28-21. Acts which will render office of member vacant.
The removal of any member of the Cultural and Arts
Commission permanently from the city, or his/her absence from
three (3) consecutive meetings of the Commission, except in case
of sickness or temporary absence from the city, without due
explanation, shall render his/her office as a member vacant .
Sec. 28-22 . Filling vacancies .
Vacancies occurring on the Cultural and Arts Commission
shall be filled by the mayor in the same manner as regular
appointments, which appointment shall be to fill out the
unexpired term for which the appointment is made .
Sec. 28-23 . Duties of the Commission.
The Cultural and Arts Commissioners shall have the following
duties :
(a) To assist with the evaluation of community needs and
review plans presented by the Director of the Cultural and Arts
Commission for future cultural and arts activities, programs, and
facilities to address those needs .
(b) To advise and recommend to the mayor and council on all
matters relating to the Cultural and Arts Commission.
(c) To review and recommend on the annual budget .
(d) To raise or assist with the raising of funds for the
purpose and benefit of the mission of this Commission.
Sec . 28-24 . Record of proceedings.
The Cultural and Arts Commission shall keep a record of its
proceedings.

Sec. 28-25. Quorum for meeting.
A quorum for purposes of any meeting of the Cultural and
Arts Commission shall be four (4) of the seven (7) members
appointed.
Sec. 28-26 . Disposition of grants, gifts, and donations .
All grants, gifts, donations, or payments whatsoever which
are received by the city for the benefit of the Cultural and Arts
Commission or by said Commission, shall be disbursed as
determined by the Director of the Cultural and Arts Commission.
