ORDINANCE NO. 4348
ORDINANCE AMENDING ORDINANCE NO. 2479, AS
AMENDED, BY ADDING SUBSECTION NO. 312 TO
SECTION 2A-5, REZONING CERTAIN PROPERTY.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
Section 1 . That Section 2A-5, of Ordinance No. 2479, as
amended, be further amended by adding after Subsection No. 312 , of
said Section, the following Subsection No. Three Hundred Twelve
(312) .
"312 .
The North One (1) acre of the Southwest Quarter (SW'A)
of the Southeast Quarter (SE%) of the Northwest Quarter
(NW%/,) of Section Twenty-nine (29) , and,
The South One (1) acre of the Northwest Quarter (NW'%)
of the Southeast Quarter (SE%) of the Northwest Quarter
(NW'A) of Section Twenty-nine (29) , and,
The South Nine (9) acres of the Southwest Quarter (SE%/,)
of the Southeast Quarter (SE%) of the Northwest Quarter
(NW%) of said Section Twenty-nine (29) except the West
Twenty-five (25) feet thereof, and, except the South
Three Hundred Thirty (330) feet thereof, and,
The East One-half (Es) of the Southeast Quarter (SE'A)
of the Northwest Quarter (NW%) of said Section Twenty-
nine (29) , all in Township Eighty-nine North (T89N) ,
Range Twelve West (R12W) of the Fifth Principal
Meridian, City of Waterloo, Black Hawk, County, Iowa;
except the East Three Hundred Thirty (330) feet
thereof, and, except the South Three Hundred thirty
(330) feet thereof .
Also, except that part of the Southeast Quarter (SE%)
of the Northwest Quarter (NW%) of said Section Twenty-
nine (29) described as follows :
Beginning at the East line of Bishop Avenue, Waterloo,
Iowa, and the North line of the South One (1) acre of
the Northwest Quarter (NW'4) of the Southeast Quarter
(SE%) of the Northwest Quarter (NW4) of said Section
Twenty-nine (29) ; thence Three Hundred (300) feet East
along said North line of said South One (1) acre;
thence South parallel with Bishop Avenue One Hundred
Forty (140) feet; thence West Three Hundred (300) feet
parallel with the North line of said South One (1) acre
to the East line of Bishop Avenue; thence North One
Hundred Forty (140) feet to the point of beginning, all
in the City of Waterloo, Black Hawk County, Iowa;
now zoned on the Zoning Map of Waterloo, Iowa, as "A-1"
Agricultural District, be and the same is hereby zoned as "R-
2" One and Two Family Residence District as above described
subject to the following conditions .
1 . Fire and Sanitation Departmental approval of the
turning radius at the end of the cul-de-sac of the
proposed Scotch Grove Avenue
2 . That only one access is granted off of Bishop Avenue
from Lot 2 and that this language be included in the
Deed of Dedication to be submitted with the final
plat .

3 . That the Twenty-five (25) feet of right-of-way along
Cottage Grove Avenue east of the platted Ogden Avenue
and west of Maywood Avenue be vacated, sold and
conveyed to the applicant at a cost of the average
assessed value of the surrounding land. "
Section 2 . That the City Clerk be, and she is hereby
directed to file a certified copy of this Ordinance with the
Recorder of Black Hawk County, Iowa.
