AN ORDINANCE VACATING A PORTION OF STREET
RIGHT-OF-WAY GENERALLY LOCATED ON THE SOUTH
SIDE OF W. SAN MARNAN DRIVE BETWEEN NICKI
STREET AND JONATHAN STREET IN THE CITY OF
WATERLOO, BLACK HAWK COUNTY, IOWA.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
as follows:
That part of the Northeast Quarter of the Northeast Quarter
(NEI. - NE4 ) of Section Nine ( 9) , Township Eighty-eight North
(T88N) , Range Thirteen West (R13W) of the Fifth Principal
Meridian, Black Hawk County, Iowa, described as follows:
Commencing at the Northwest corner of said Northeast Quarter
of the Northeast Quarter (NEI. ) - NEI. ) ; thence S00°26 ' 14" E
along the West line of said Northeast Quarter of the Northeast
Quarter (NE4 - NE4 ) a distance of Sixty-three and forty-three
hundredths ( 63. 43 ) feet to the South line of West San Marnan
Drive; thence S89°03 ' 48"E Two hundred Ninety-eight and Ninety-
seven hundredths ( 298. 97) feet along said South line of West
San Marnan Drive to the Point of Beginning; thence continuing
S89°03 ' 48"E Ninety-two and No hundredths ( 92.00) feet along
the South line of West San Marnan Drive and the North line of
Lot Two ( 2) of Tower Park Addition to the City of Waterloo,
Iowa, to the Northwest corner of Lot Three ( 3 ) in said Tower
Park Addition; thence continuing S89°03 ' 48"E Three hundred
Nine and Twenty-three hundredths ( 309. 23 ) feet along the North
line of said Lot Three ( 3 ) to the Northeast corner of said Lot
Three ( 3) and the West line of Nicki Street; thence

an extension of the West line of Nicki Street; thence

the Point of Beginning, containing One thousand Nine hundred

Feet, all in the City of Waterloo, Black Hawk -County, Iowa;
shall be, and the same is hereby vacated, with the City' s retention
of an easement over, under and above the described parcel.
