ORDINANCE AMENDING ORDINANCE NO. 2479, AS
AMENDED, BY ADDING SUBSECTION NO. 296 TO
SECTION 2A-5, REZONING CERTAIN PROPERTY.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
Section 1. That Section 2A-5, of Ordinance No. 2479 , as
amended, be further amended by adding after Subsection No. 295, of
said Section, the following Subsection No. Two Hundred Ninety-six
( 296) .
"296.
All that part of the East one-half of Section No. Four ( 4) ,
Township No. Eighty-eight ( 88) North, Range No. Thirteen ( 13 )
West of the Fifth Principal Meridian, in the City of Waterloo,
Black Hawk County, Iowa, bounded as follows:
Commencing at the Northeast corner of Tract "A" in Southgate
First Addition; thence South Eighty-nine ( 89) degrees Forty
( 40) minutes Fifty-three ( 53 ) seconds West along the North
line of said Tract "A" a distance of Fifty ( 50) feet to the
Southeast Corner of said Tract "A" ; thence South One ( 1)
degree Twelve ( 12) minutes Twelve ( 12) seconds East along the
West line of said Tract "A" a distance of Fifty ( 50) feet to
the Southwest Corner of said Tract "A" ; thence South Eighty-
nine ( 89) degrees Forty ( 40) minutes Fifty-three ( 53 ) seconds
West along a line parallel with and Thirty ( 30) feet South of
the South line of the Northeast Fractional Quarter of said
Section a distance of Three Hundred Seventy and Nineteen
Hundreds ( 370. 19 ) feet; thence North zero degrees no minul:es
Seven (7) seconds West a distance of Four Hundred Thirty-one
and Twenty-four Hundreds ( 431. 24) feet; thence North Eighty-
nine ( 89) degrees Thirty-eight ( 38) minutes Thirteen ( 131
seconds East a distance of Four Hundred Ten and Fourteen
Hundreds ( 410 . 14) feet to the Westerly line of Kimball Avenue;
thence South one ( 1) degree Twelve ( 12) minutes Twelve ( 12)
seconds East along the Westerly line of Kimball Avenue a
distance of Three Hundred Eighty-one and Seventy-two Hundreds
( 381.72) feet to the point of beginning, all in the City of
Waterloo, Black Hawk County, Iowa,
now zoned on the Zoning Map of Waterloo, Iowa, as "R-3" Multiple
Family Residence District to "R-4" Multiple Family Residence
District as above described subject to the following conditions:
1. Review by the Planning Commission and City Council of any
future development on that portion of the site north of
the proposed clinic.
2. A traffic impact analysis of the area.
3 . No multi-family residential development to occur on any
portion of the requested site. "
Section 2. That the City Clerk be, and she is hereby directed
to file a certified copy of this Ordinance with the Recorder of
Black Hawk County, Iowa.
