HomeMy WebLinkAbout4238-07/14/1997 ORDINANCE NO. 4238 AN ORDINANCE VACATING A PORTION OF LINCOLN STREET GENERALLY LOCATED BETWEEN RIEHL AND DAWSON STREETS, AT THE CROSSING WITH THE ILLINOIS CENTRAL RAILROAD IN THE CITY OF WATERLOO, BLACK HAWK COUNTY, IOWA. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, as follows : Vacate an easement granted by the railroad (known as the Dubuque and Sioux City Railroad Company in May 1917) to the City of Waterloo for street purposes and recorded in Town Lot Deed Record Book 94, pages 318-319, as follows : All that part of the right-of-way of the Dubuque and Sioux City Railroad Company commencing at the point of intersection of the West line extended of that part of Lincoln Street, lying South of Riehl Street, with the Southwesterly line of the right-of-way of said Railroad Company; thence running Northwesterly to the point of intersection of the West line extended of that part of Lincoln Street lying North of Dawson Street with the Northeasterly line of said Right-of-Way; thence Southeasterly along the Northeasterly line of said right-of-way to a point forty-six and five tenths (46 . 5) feet distant, at right angles, from the first described line; thence Southeasterly parallel with and forty-six and five tenths (46 . 5) feet distant from the first described line, to the Southwesterly line of the right-of-way of said Railroad Company; thence Northwesterly to the place of beginning, all in the City of Waterloo, Black Hawk County, Iowa; and also, That part of Lincoln Street right-of-way described as follows : All of Lot 9, Block 11, East Park Place, except the east thirty-five (35) feet, all in the City of Waterloo, Black Hawk County, Iowa; and also, That part of Lincoln Street right-of-way described as follows : All of Lot 6, Block 1, Calumet Addition, except the west fifty (50) feet, all in the City of Waterloo, Black Hawk County, Iowa. shall be, and the same is hereby vacated, with the City' s retention of an easement over, under and above the described parcel .
