ORDINANCE AMENDING ORDINANCE NO. 2479, AS
AMENDED, BY ADDING SUBSECTION NO. 78 TO
SECTION 2A-7N, REZONING CERTAIN PROPERTY.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
Section 1 . That Section 2A-7N, of Ordinance No. 2479, as
amended, be further amended by adding after Subsection No. 77, of
said Section, the following Subsection No. Seventy-Eight (78) .
"78 .
Unplatted Waterloo West Part of the NE SW Section 3 Township
88 Range 13 Beginning at Northwest corner NE SW Section 3
thence South along West line NE SW Three Hundred Feet (300 ' )
to North Line Park Lane thence Southeasterly along
Northeasterly line Park Lane extended Three Hundred Thirty
Feet (330 ' ) thence North 32 Degrees 23 Minutes East Four
Hundred Seventy-seven and Thirty-six Hundredths (477 .36) feet
to Southwesterly line Lot 204 Crestview 2nd Addition to North
line NE SW thence West along North line NE SW Three Hundred
Ninety-six feet and Ninety-nine Hundredths (396 . 99) feet to
beginning, all in the City of Waterloo, Black Hawk County,
Iowa;
now zoned on the Zoning Map of Waterloo, Iowa, as " "R-2" , One and
Two Family Residence District, be and the same is hereby zoned as
"R-2" One and Two Family Residence District/"C-Z" , Conditional
Zoning as above described, subject to the following conditions:
1 . Subject to the site plan on file in the City Planning,
Programming and Zoning Department
.2 . The applicant keeps the existing structure at one story
in height .
3 . The applicant agrees to allow a portion of parking area
to be used by patrons of the adjacent BOntrager Park,
primarily in the off hours.
4 . The applicant agrees to implement adequate screening
per zoning ordinance requirements from the adjacent
residential areas to the west. Such screening will be
needed along the westerly edge of the parking area.
5 . All exterior lighting will be directed towards site and
not shine upon the adjacent residential property. "
Section 2 . That the City Clerk be, and she is hereby
directed to file a certified copy of this Ordinance with the
Recorder of Black Hawk County, Iowa.
