ORDINANCE AMENDING ORDINANCE NO. 2479, AS
AMENDED, BY ADDING SUBSECTION NO. 51 TO
SECTION 2A-7N, REZONING CERTAIN PROPERTY.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
Section 1. That Section 2A-7N, of Ordinance No. 2479, as
amended, be further amended by adding after Subsection No. 50, of
said Section, the following Subsection No. Fifty-one ( 51) .
"51.
That part of the Northeast Quarter of Section No. 7, Township
No. 88 North, Range No. 13 West of the Fifth Principal
Meridian in Black Hawk County, Iowa, described as follows:
Commencing at a point on the West line of said Northeast
Quarter that is 256. 5 feet South of the Northwest corner of
said Northeast Quarter; thence South 53 degrees 48 minutes 45
seconds East 370.7 feet to a point that is 300 feet East of
the West line of said Northeast Quarter and 260 feet South of
the South right of way line of former Iowa State Highway No.
412; thence North 79 degrees 48 minutes 30 seconds East 398.83
feet to the point of beginning; thence South 11 degrees 12
minutes 15 seconds East 329. 65 feet; thence North 78 degrees
47 minutes 45 seconds East 345. 53 feet to the intersection of
aline drawn normally Southwesterly through a point on the
center line of said U.S. Highway No. 520 at Station 365+00;
thence North 21 degrees 50 minutes 30 seconds East along said
line 387 . 22 feet to a point that is 245 feet Southerly of U.S.
Highway center line; thence Southwesterly 556.7 feet along the
Southerly line of said U.S. Highway to the point of beginning,
all in the City of Waterloo, Black Hawk County, Iowa,
now zoned on the Zoning Map of Waterloo, Iowa, as "C-Z" Conditional
Zoning District, be and the same is hereby extended for three years
as "C-Z" Conditional Zoning District" , subject to the following
conditions:
1 . City approved, dust-free surfacing is to be used for the
storage site and the private roadway into the site, and
2 . Vehicles are to be parked no closer than 800 feet to the
Timberline Condominiums property, and
3 . Hours of operations are to be from 6:00 a.m. to 8: 00
p.m. , Monday through Saturday, and
4. This rezoning be brought back to the Planning,
Programming & Zoning Commission for an annual review of
the site.
5. All evidence of the use of the storage site would be
removed after December 31, 1996.
Section 2 . That the Acting Clerk/Auditor be, and he is hereby
directed to file a certified copy of this Ordinance with the
Recorder of Black Hawk County, Iowa.
