AN ORDINANCE VACATING A PORTION OF WELLINGTON
COURT BETWEEN WEST FOURTH STREET AND WEST
FIFTH STREET, A PORTION OF WELLINGTON STREET
BETWEEN WEST FOURTH STREET AND WEST SIXTH
STREET AND A PORTION OF WEST FIFTH STREET
BETWEEN GRANT AVENUE AND WELLINGTON STREET IN
THE CITY OF WATERLOO.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
as follows:
All that part of the right-of-way of West Fifth Street and
Wellington Street adjacent to Blocks 4 and 5, Miller' s
Addition, in Waterloo, Black Hawk County, Iowa, lying within
the following described boundary:
Beginning at a point on the Southeasterly line of Lot 2 in
said Block 5 , which point is 100 . 00 feet Northeasterly from
the most Southerly corner of Lot 3 in said Block 5; thence
North 45°02' 07" East along the Northwesterly R-0-W line of
West Fifth Street a distance of 295 . 49 feet to the most
Easterly corner of Lot 6 in said Block 5; thence North
55°49' 17" West along the Southwesterly R-O-W Line of
Wellington Street a distance of 13 . 42 feet; thence
Northeasterly along a 610 . 16-Foot radius curve, concave
Northerly and having an 83 . 29-Foot long chord bearing North
62°57 ' 20" East, an arc distance of 83 . 35 feet; thence South
55°49 ' 17" East along a line which is 7 . 0 feet normally distant
Southwesterly from and parallel with the Southwesterly line of
Block 18, Doe' s Addition, a distance of 128. 52 feet; thence
South 34°10' 43" West a distance of 21. 26 feet; thence South
79°03 ' 28" West a distance of 67 . 47 feet; thence Southwesterly
along a 612.96-Foot radius curve concave Southeasterly and
having a 5 . 52-Foot long chord bearing South 78°47 ' 44" West an
arc distance of 5 . 52 feet to the Northeasterly line of Lot 4
in said Block 4; thence North 55°49' 17" West a distance of
22. 25 feet to the most Northerly corner of Lot 4 in said Block
4; thence South 45°02 ' 07" West along the Northwesterly line of
Lot 4 in said Block 4 a distance of 31 . 40 feet; thence
Southwesterly along a 612.96-Foot radius curve concave
Southeasterly and having a 290. 54-Foot long chord bearing
South 60°55' 41" West an arc distance of 293 . 33 feet; thence
North 45°00 ' 00" West parallel with the Southwesterly line of

beginning, containing approximately 19,191 . 22 square feet;

All that part of the alley known as Wellington Court adjacent
to Block 1, Leavitt' s Addition and Block 5, Miller' s Addition,
Waterloo, Black Hawk County, Iowa, lying within the following
described boundaries:
Beginning at the point of intersection of the Northwesterly
right-of-way line West Fifth Street ( Southeasterly line of
said Block 5) with a line which is 4 . 00 feet normally distant
Northeasterly from and parallel with the Southwesterly right-
of-way line of Wellington Court ( the Northeasterly line of Lot
1 in said Block 5) ; thence North 45°02' 07" East a distance of
16. 31 feet to the most Southerly corner of Lot 6 in said Block
5; thence North 56°03 ' 27" West along the Northeasterly right-
of-way line of Wellington Court ( the Southwesterly line of Lot
6 in said Block 5 and the Southwesterly line of Lot 10 in said
Block 1) a distance of 109 . 60 feet; thence Westerly along a
606 . 50-Foot radius curve concave Northerly and having a 24 . 98-
Foot long chord bearing South 84°05 ' 30" West, an arc distance
of 24 .98 feet; thence South 56°03 ' 27" East along a line which
is 4 . 00 Feet normally distant Northeasterly from and parallel

a distance of 125 . 63 feet to the point of beginning,
containing approximately 1,880 S.F. ,
shall be, and the same is hereby vacated, with the City' s retention
of a permanent utility easement over, under and above the described
parcel.
