ORDINANCE NO. 5502 ORDINANCE AMENDING ORDINANCE NO. 5079, AS AMENDED, CITY OF WATERLOO ZONING ORDINANCE, BY AMENDING THE OFFICIAL ZONING MAP REFERRED TO N SECTION 10-4-4, TO APPROVE A REQUEST BY THE DGOGWATERLOOIA10032018, LLC, (DOLLAR GENERAL) OF WEST PLAINS, MISSOURI, FOR A SITE PLAN AMENDMENT TO THE "C -P" PLANNED COMMERCIAL DISTRICT TO ALLOW FOR THE CONSTRUCTION OF A 9,100 SQUARE FOOT DOLLAR GENERAL RETAIL STORE LOCATED NORTHEAST OF THE MARTI\ LUTHER KNG, JR. DRIVE AND IDAHO STREET INTERSECTION, AND RESCINDING ORDINANCE NO. 5496 IN ITS ENTIRETY BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA AS FOLLOWS: Section 1. That the Official Zoning Map referred to in Section 10-4-4 of Ordinance No. 5079 as amended, City of Waterloo Zoning Ordinance, be amended to approve a site plan amendment to the "C -P" Planned Commercial District, to allow for the construction of a 9,100 square foot Dollar General retail store, located northeast of the Martin Luther King, Jr. Drive and Idaho Street intersection, and legally described as follows: DESCRIPTION OF PARCEL "H" A PART OF THE SOUTHEAST 1/4 OF SECTION 19, TOWNSHIP 89 NORTH, RANGE 12 WEST OF THE 5TH P.M., AND A PART OF EXISTING IDAHO STREET N THE SOUTHEAST 1/4 OF SAID SECTION 19, ALL I\ THE CITY OF WATERLOO, COUNTY OF BLACK HAWK, STATE OF IOWA, MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT THE CENTER OF SAID SECTION 19; THENCE NORTH 88° (DEGREES) 43' (MINUTES) 55" (SECONDS) EAST (ASSUMED BEARING FOR THE PURPOSE OF THIS DESCRIPTION) ON THE NORTH LINE OF THE SOUTHEAST 1/4 OF SAID SECTION 19 A DISTANCE OF 16.50 FEET TO THE PRESENT EAST RIGHT-OF-WAY LINE OF IDAHO STREET, THE POINT OF BEGINNING OF THE PARCEL HEREIN DESCRIBED; THENCE NORTH 88°43'55" EAST ON THE NORTH LINE OF THE SOUTHEAST 1/4 OF SAID SECTION 19, ALSO BEING TIL. PRESENT EAST RIGHT-OF-WAY LINE OF IDAHO STREET AND ITS EXTENSION EASTERLY, 182.94 FEET TO THE SOUTHWESTERLY LINE OF THE CANADIAN NATIONAL RAILROAD; THENCE SOUTHEASTERLY ON THE SOUTHWESTERLY LINE OF THE CANADIAN NATIONAL RAILROAD, BEING A 1,879.86 -FOOT RADIUS CURVE CONCAVE SOUTHWESTERLY AND HAVING A 105.63 -FOOT LONG CHORD BEARING SOUTH 46°28'08" EAST, 105.64 FEET (ARC LENGTH); THENCE SOUTHWESTERLY ON A 211.04 -FOOT RADIUS CURVE CONCAVE SOUTHEASTERLY AND HAVING A 215.72 -FOOT LONG CHORD BEARING SOUTH 12°01'17" WEST, 226.42 FEET (ARC LENGTH); THENCE SOUTH 52°56'38" WEST, 67.54 FEET; THENCE NORTH 70°38'19" WEST, Ordinance No. 5502 Page 2 164.88 FEET; THENCE NORTH 01°05'55" WEST, 265.78 FEET TO THE POINT OF BEGINNING. BY SURVEY CONTAINING 63,883 SQUARE FEET, OR 1.47 ACRES shall be, and is hereby approved. BE IT FURTHER ORDAINED that Ordinance No. 5496 be, and the same hereby is rescinded in its entirety.
