HomeMy WebLinkAbout4041-09/26/1994 ORDINANCE NO. 4041 AN ORDINANCE AMENDING THE 1993 CODE OF ORDINANCES OF THE CITY OF WATERLOO, IOWA, BY REPEALING SUBSECTION (a) OF SECTION 14-60, ANNUAL LIFE SAFETY PERMITS, LICENSES AND CERTIFICATION FEES; SECTION 14-63 , FLAMMABLE AND COMBUSTIBLE LIQUIDS, OF ARTICLE III , FIRE PREVENTION INSPECTIONS, OF CHAPTER 14, FIRE PREVENTION AND PROTECTION; AND ENACTING IN LIEU THEREOF A NEW SUBSECTION (a) OF SECTION 14-60, ANNUAL LIFE SAFETY PERMITS, LICENSES AND CERTIFICATION FEES; SECTION 14-63 , FLAMMABLE AND COMBUSTIBLE LIQUIDS, OF ARTICLE III, FIRE PREVENTION INSPECTIONS, OF CHAPTER 14, FIRE PREVENTION AND PROTECTION. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, as follows: That Subsection ( a) of Section 14-60, Annual Life Safety Permits, Licenses and Certification Fees, and Section 14-63 , Flammable and Combustible Liquids, of Article III, Fire Prevention Inspections, of Chapter 14, Fire Prevention and Protection, are hereby repealed in their entirety; that new Subsection ( a) of Section 14-60 Annual Life Safety Permits, Licenses and Certification Fees, and Section 14-63 , Flammable and Combustible Liquids, of Article III, Fire Prevention Inspections of Chapter 14, Fire Prevention and Protection, are hereby enacted in lieu thereof as follows: Sec. 14-60. Annual life safety permits, license and certification fees. The following fees shall be established for the permits, licenses, certificates, approvals, life safety inspections and other functions performed under this Code and shall be payable by the non-residential businesses to the City of Waterloo. Such fees shall accompany each application for such permit, approval, certificate, or other fee-related Code provisions. (a) NON-RESIDENTIAL BUSINESSES ANNUAL FEE SCHEDULE FOR LIFE SAFETY INSPECTION* A sliding fee schedule will be developed according to square footage of the building, which will also be classified by the relative hazard of the occupancy, i.e. low hazard (LH) , ordinary hazard (OH) , or high hazard (HH) . Low hazard occupancies shall be as defined in Division 4 of Section 701, Uniform Building Code. Ordinary hazard occupancies shall be as defined in Division 1 , 2 and 3 of Section 701, Uniform Building Code. High hazard occupancies shall be as defined in Section 901 of the Uniform Building Code. *Non-residential businesses who install a certified sprinkler system will be exempt from the Annual Life Safety Inspection Fee for three ( 3) years after the installation of the sprinkler system. Church facilities will be exempt for this when used solely for religious services. **Reinspection fees do not apply if violations are corrected prior to the scheduled reinspection date. At the time of the initial inspection, the occupant and/or owner will receive a copy of the life safety inspection indicating which violations need to be corrected. Along with this will be a standard letter listing the date or reinspection as well as the schedule of fees, as listed above. Fees will be assessed, if they do not comply at the time of the first, second, or third reinspection date. If the Fire Marshal is notified in writing by mail or hand delivered to the Fire Marshal in a timely manner, and repairs, are scheduled, a reinspection date may be rescheduled to allow more time to complete repairs. Non-profit entities, churches and governmental agencies are not exempt from the reinspection fees as listed above. Sec. 14-63 . Flammable and combustible liquids. ( a) Permit required. This shall include, but not be limited to, gasoline, diesel, oil, waste oil and other flammable and combustible liquids. Tanks Each tank 200. 00 Flammable/combustible liquid tank modification: This shall include all flammable/combustible liquid tanks and required piping, valves and dispensing equipment. Tanks may be of the aboveground or belowground type. Modification shall include reconstruction, tapping, tank cutting, vent pipe relocations, dispenser piping, repiping and tank repair of repiping. Modifications As described above 50. 00 Note: If the valuation of the work performed exceeds 50 percent of the replacement cost of the system the fees for a new installation shall apply. Underground tank removal: This shall apply to the removal of flammable or combustible liquid tanks in accordance with regulation 16-B of the Waterloo Fire Code.
