BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA: Section 1. That Section 2A-5, of Ordinance No. 2479, as amended, be further amended by adding after Subsection No. 283, of said Section, the following Subsection No. Two Hundred Eighty-four (284). "234. A part of the Southwest Quarter of the Northwest Quarter and the Northwest Quarter of the Southwest Quarter of Section 5, Township 88 North, Range 13 West of the 5th P.M., Waterloo, Black Hawk County, Iowa, described as follows: Beginning at the Southwest Corner of the Southwest Quarter of the Northwest Quarter of said Section 5; thence North V00' East 344.76 feet along the West line of said Southwest Quarter of the Northwest Quarter to the Southeasterly line of Marnie Avenue extended; thence North 35°59'13" East 216.11 feet along said Southeasterly line of Marnie Avenue extended to the Southwest corner of Lot 16, Kingswood Second Addition; thence North 90° 00' East 513.13 feet along the South line of said Lot 16 to the Southeast corner of Lot 16; thence South 0° 00' East 100.00 feet along a line that is parallel with and 640.00 feet East of the West line of the Northwest Quarter of said Section 5 to the Northwest corner of Lot 15, Kingswood First Addition; thence South 23° 59' 22" East 680.55 feet along the Westerly line of Kingswood First Addition to the Southerly corner of Lot 8, Kingswood First Addition; thence South 89° 51' 30" West 918.57 feet to the West line of the Northwest Quarter of the Southwest Quarter of said Section 5; thence North 0° 29' 30" East 204.41 feet along said West line to the point of beginning, except that part south of the south line of Kingswood Place extended from the westerly line of Kingswood First Addition, all in the City of Waterloo, Black Hawk County, Iowa. The West line of the Southwest Quarter of the Northwest Quarter is assumed to bear North-South in this description, now zoned on the Zoning Map of Waterloo, Iowa, as "M -l" Light industrial District to "R-4" Multiple Family Residence District as above described", subject to the following conditions: 1. Construction of no more than 144 units. 2. The units will be similar to the rendering displayed at the Planning, Programming and Zoning Commission meeting. 3. Extension of Marnie Avenue to the property and dedicate to city. 4. Reserve the right to build in the flood plain if buildings are raised above the 100 year flood plain meet all city requirements. the and 5. Will work with the city on a closure plan of Kingswood Place. Section 2. That the Deputy City Clerk be, and she is hereby directed to file a certified copy of this Ordinance with the Recorder of Black Hawk County, Iowa.
