RESOLUTION ACCEPTING AND APPROVING PERMANENT
H o EASEMENT AGREEMENT WITH THE ROSE OF WATERLOO

LP AND DIRECTING EXECUTION OF SAID AGREEMENT

WHEREAS, that the Permanent Easement Agreement of the
hereinafter described parcel is to allow for a portion of public
o sidewalk to encroach approximately 6 feet onto private property
-generally located at the northwest corner of Oak Avenue and
Mulberry Street .
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
'WATERLOO, IOWA, that the Permanent Easement Agreement, by and
between the Rose of Waterloo LP, for the parcel hereinafter
. described, all of which is situated in the City of Waterloo,
Black Hawk County, Iowa, is accepted and approved:
Starting at the southeasterly corner of Parcel E in the
s s Southeast Quarter (SE'i) of Section Twenty-Three (23) ,
7 Township Eighty-Nine North (T89N) , Range Thirteen West
` ` (R13W) of the Fifth Principal Meridian (5th P.M. ) in

Q the City of Waterloo, Black Hawk County, State of Iowa
tri as Recorded in Document #2009008989, thence
`' northeasterly 5 . 90 feet along the current west line of
Oak Avenue, thence southwesterly to the north line of
Mulberry Street to a point which is 5 . 32 feet westerly
from the southeasterly corner of Parcel E, thence to
the point of beginning.
PASSED AND ADOPTED this 5th day of January, 2009, and
approved by the Mayor on the 7th day of January, 2009 .
