P7-) RESOLUTION APPROVING ENCROACHMENT AGREEMENT
H n s WITH THE ROSE OF WATERLOO LP AND DIRECTING
CD EXECUTION OF SAID AGREEMENT BY MAYOR.
BE. IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
that the Encroachment Agreement dated January 5, 2009, to allow
for five decorative pillars to encroach into public right-of-way
generally located along Mulberry and Utica Streets as well as Oak
Avenue extending between 0 . 2 feet to 0 . 8 feet into the right-of-
way, legally described as follows :
Parcel "E", being all of Lot Eight (8) and parts of
Lots One (1) , Two (2) and Three (3) of Uriah Dubois
Addition and parts of Lots Forty-eight (48) and Forty-
nine (49) of Morris Case Addition, of the Southeast
Quarter (SE1/4 ) of Section Twenty-three (23) , Township
Eighty-nine (89) North, Range Thirteen (13) West of the
Fifth Principal Meridian (5th P.M. ) , in the City of
Waterloo, Black Hawk County, State of Iowa, as shown on
the "Plat of Survey" filed in the office of the
Recorder of Black Hawk County, Iowa on August 17, 2006,
and recorded as Document No. 2007004077;
by and between the Rose of Waterloo LP and the City of Waterloo,
Iowa, be and the same is hereby approved, and the Mayor and City
Clerk authorized to execute the same in behalf of the City of
Waterloo, Iowa.
PASSED AND ADOPTED this 5th day of January, 2009.
