AN ORDINANCE VACATING A PORTION OF STREET
RIGHT OF WAY GENERALLY LOCATED ON THE NORTH
SIDE OF E. SAN MARNAN DRIVE FRONTAGE ROAD
BETWEEN SOUTHBROOK DRIVE AND WEST NINTH STREET
IN THE CITY OF WATERLOO, BLACK HAWK COUNTY,
IOWA.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
as follows:
That part of vacated East San Marnan Drive lying South of and
adjacent to Lot 4 and 5, Southbrooke Second Addition, A Replat
of Tract F, Southbrooke, Waterloo, Black Hawk County, Iowa,
described as follows:
Commencing at the Southeast corner of Lot No. 5, Southbrooke
Second Addition; thence S 00°01'00" E a distance of 30.00
feet; thence N 88°30'44" W a distance of 324.44 feet; thence
N 00°28'49" W a distance of 30.00 feet to the Southwest corner
of Lot No. 4, Southbrooke Second Addition; thence S 88°30'44"
E along the Southerly line of Lots 4 and 5, Southbrooke Second
Addition a distance of 324.44 feet to the point of beginning,
The Southerly line of Lots 4 and 5 is assumed to bear S
88°30'44" E. Said parcel contains approximately 721.35 sq.
ft., all in the City of Waterloo, Black Hawk County, Iowa,
shall be, and the same is hereby vacated, with the City's retention
of underground utility easement over, under and above the East
30.00 feet thereof.
