RESOLUTION NO. 2009-57
RESOLUTION ACCEPTING AND APPROVING CERTAIN
ACQUISITION CONTRACT TO SELL REAL PROPERTY TO
THE CITY AND ACCEPTING AND APPROVING CERTAIN
DEED IN CONJUNCTION WITH WEST BIG ROCK ROAD
BOX CULVERT IMPROVEMENTS .
WHEREAS, the City of Waterloo, Iowa, has had the parcel
described herein appraised and the fair market value ascertained,
and
WHEREAS, the acquisition of the hereinafter described parcel
is in conjunction with the West Big Rock Road Box Culvert
Improvements .
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WATERLOO, IOWA, that the contract for the parcel
hereinafter described to sell the same to the City of Waterloo,
Iowa, all of which is situated in the City of Waterloo, Black
Hawk County, Iowa, is accepted and approved and the Mayor and
City Clerk are authorized and directed to execute the same in
behalf of the City and to execute all instruments necessary to
consummate the agreement to purchase the property from the owners
thereof, and the deed for the conveyance of the same is also
accepted and approved and the City of Waterloo is directed to pay
for the property and the incidental expenses necessary to the
consummation of the sale from City funds .

A parcel of land situated in the Northeast 1/ of Section
3 , Township 89 North, Range 13 West of the 5th
Principal Meridian, City of Waterloo, County of Black
Hawk, State of Iowa, more particularly described as
follows :
Commencing at the North 1/ corner of said Section 3 ;
thence North 89° (Degrees) 04 ' (Minutes) 56" (Seconds)
East (assumed bearing for the purpose of this
description) on the North line of the Northeast 1/ of
said Section 3 , a distance of 24 . 18 feet; thence South
00°55 ' 04" East, 53 . 00 feet to the intersection of the
present South right-of-way line of Big Rock Road and
the East line of the C. C. &P. Railroad (formerly the
W. C. F. &N. Railroad) , being the point of beginning;
thence North 89°04 ' 56" East on said right-of-way line,
78 . 91 feet; thence South 00°01' 44" East, 10 . 50 feet;
thence South 89°04 ' 56" West, 78 . 91 feet to the East
line of the C. C. &P. Railroad (formerly the W. C. F. &N.
Railroad) ; thence North 00°01' 44" West on said East
line, 10 . 50 feet to the point of beginning.
Containing 828 square feet or 0 . 02 acre, all in the
City of Waterloo, Black Hawk County, Iowa;
be and the same is hereby approved and accepted.
