RESOLUTION NO. 2009-58 RESOLUTION APPROVING AND ACCEPTING CERTAIN PARTIAL ACQUISITION CONTRACT AND ACCEPTING AND APPROVING CERTAIN DEED TO SELL REAL PROPERTY TO THE CITY AND TWO TEMPORARY CONSTRUCTION EASEMENT AGREEMENTS IN CONJUNCTION WITH WEST BIG ROCK ROAD BOX CULVERT IMPROVEMENTS . WHEREAS, the City of Waterloo, Iowa, has had the parcels described herein appraised and the fair market value ascertained, and WHEREAS, the acquisition of the hereinafter described parcels is necessary to carry out the West Big Rock Road Box Culvert Improvements . NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that the contracts for the parcels hereinafter described to sell the same to the City of Waterloo, Iowa, all of which are situated in the City of Waterloo, Black Hawk County, Iowa, are accepted and approved and the Mayor and City Clerk are authorized and directed to execute the same in behalf of the City and to execute all instruments necessary to consummate the agreement to purchase the property from the owners thereof, and the deed for the conveyance of the same are also accepted and approved and the City of Waterloo is directed to pay for the property and the incidental expenses necessary to the consummation of the sale from City funds . The subject parcels are : Owner: Rainbow Farms, Inc . Parcel No. : 8913-03 -201-002 Project Parcel 4 Partial Acquisition: $424 . 05 Temporary Construction Easements : $34 . 17 Partial Acquisition A parcel of land situated in the Northeast 1/ of Section 3 , Township 89 North, Range 13 West of the 5th Principal Meridian, City of Waterloo, County of Black Hawk, State of Iowa, more particularly described as follows : Commencing at the North 1/ corner of said Section 3 ; thence North 89° (Degrees) 04 ' (Minutes) 56" (Seconds) East (assumed bearing for the purpose of this description) on the North line of the Northeast 1/ of said Section 3 , a distance of 436 . 62 feet; thence South 00°55' 04" East, 33 . 00 feet to the present South right- of-way line of Big Rock Road, being the point of beginning; thence North 89°04 ' 56" East on said right- of-way line, 187 . 44 feet; thence South 67°07 ' 20" West, 86 . 84 feet; thence South 89°03 ' 20" West, 49 . 87 feet; thence North 61°14 ' 41" West, 65 . 64 feet to the point of beginning.
