AN ORDINANCE VACATING A PORTION OF STREET
RIGHT-OF-WAY GENERALLY LOCATED ON THE SOUTH
SIDE OF W. SAN MARNAN DRIVE BETWEEN KIMBALL
AVENUE AND NICKI STREET IN THE CITY OF
WATERLOO, BLACK HAWK COUNTY, IOWA.
SE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
as follows:
A part of W. San Marnan Drive right-of-way being adjacent to
Lots 4 and 5, Tower Park, Waterloo, Black Hawk County, Iowa
and in the NE 4 of Section 9-88-13 described as follows:
Beginning at the Northwest corner of said Lot 4; thence N
00°26'14" W a distance of 20.01 feet; thence S 89°03'48" E
parallel with the North line of said Lot 4 and 5 a distance of
420.38 feet; thence S 18°02'49" E a distance of 21.15 feet to
the Northeast corner of said Lot 5; thence N 89°03'48" W along
the North line of said Lots 4 and 5 a distance of 426.77 feet
to the point of beginning, containing approximately 8,471
square feet, all in the City of Waterloo, Black Hawk County,
Iowa.
The North line of Lots 4 and 5, Tower Park, Waterloo, Black
Hawk County, Iowa is assumed to bear N 89°03'48" W,
shall be, and the same is hereby vacated, with the City's retention
of an easement over, under and above the described parcel.
