C-7; AD RESOLUTION OF THE CITY OF WATERLOO REGARDING
H H REPAIRS TO FLOOD PROTECTION SYSTEM.

WHEREAS, the City of Waterloo for many years has had a flood
c protection system in place to protect public and private property
and to protect the health, safety and welfare of the general
public; and
a WHEREAS, the floods of 2008 caused damage to the flood
o, protection system which should be repaired and rehabilitated to
ensure the future integrity of the flood protection system; and
WHEREAS, a cooperation agreement (the "Agreement" ) with the
United States of America, acting by and through the U. S . Army
Corps of Engineers, has been proposed to accomplish the needed
repairs .
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS :

'- Section 1 . The City Council does hereby approve the
Agreement providing for the structural repair of the railroad
closure, adding riprap along a reach of levee, and removing
accumulated silt in channels as necessary to restore the flood
protection system to its pre-flood conditions, all as more
particularly described in the Agreement and the documents
ancillary thereto.
Section 2 . The mayor and city clerk are hereby
authorized, empowered and directed to execute, attest, seal and
deliver the Agreement for and on behalf of the City in
substantially the form and content now before this meeting, but
with such changes, modifications, additions or deletions therein
as shall be approved by such officers and that do not materially
adversely alter any promise, covenant, representation, or other
term of the Agreement affecting the rights or duties of the City,
and thereafter the mayor and city clerk are hereby authorized,
empowered and directed to do all such acts and things and to
execute all such documents as may be necessary to carry out and
comply with the provisions of the Agreement as executed.
PASSED AND ADOPTED this 9th day of February, 2009 .
