HomeMy WebLinkAbout3878-07/13/1992ORDINANCE NO. 3878 AN ORDINANCE AMENDING THE 1991 TRAFFIC CODE BY: ADDING SECTION 440A, REPAIR OF LAMPS WITHIN 72 HOURS OF CITATION; AND BY REPEALING SECTION 442, REAR LAMPS AND REFLECTORS; SECTION 455, REQUIRED USAGE OF LIGHTING DEVICES; AND SUBSECTION (2)(e) OF SECTION 491, SAFETY BELTS AND SAFETY HARNESSES --USE REQUIRED; AND BY ENACTING IN LIEU THEREOF NEW SECTION 442, REAR LAMPS AND REFLECTORS; NEW SECTION 455, REQUIRED USAGE OF LIGHTING DEVICES; AND NEW SUBSECTION (2)(e) OF SECTION 491, SAFETY BELTS AND SAFETY HARNESSES --USE REQUIRED. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA: That Section 440A, Repair of Lamps Within 72 Hours of Citation, is hereby added to the 1991 Traffic Code as follows: SECTION 440A. REPAIR OF LAMPS WITHIN 72 HOURS OF CITATION. A citation issued for failure to have lamps or lights as required under Section 440, 441, 442, or 445 shall first provide for a seventy-two (72) hour period within which the person charged with the violation shall replace or repair the lamp(s) or light(s). If the person complies with the directive to replace or repair the lamps or lights within the allotted time period, the citation shall be expunged. If the person fails to comply within the allotted time period, the citation shall be processed in the same manner as other citations. A citation issued under this section shall include a written notice of replacement or repair which shall indicate the date of replacement or repair and the manner in which the replacement or repair occurred and which shall be returned to the issuing authority within the seventy-two (72) hour time period. [Ref. 74th G.A., eff. 7/1/92, §321.385A] That Section 442, Rear Lamps and Reflectors; Section 455, Required Usage of Lighting Devices; and Subsection (2)(e) of Section 491, Safety Belts and Safety Harnesses --Use Required, of the 1991 Traffic Code, are hereby repealed in their entirety; and that new Section 442, Rear Lamps and Reflectors; new Section 455, Required Usage of Lighting Devices; and new Subsection (2)(e) of Section 491, Safety Belts and Safety Harnesses --Use Required, of the 1991 Traffic Code, are hereby enacted in lieu thereof as follows: SEC. 442. REAR LAMPS AND REFLECTORS. Every motor vehicle and every vehicle which is being drawn at the end of a train of vehicles shall be equipped with a lighted rear lamp or lamps, exhibiting a red light plainly visible from a distance of five hundred feet to the rear. All lamps and lighting equipment originally manufactured on a motor vehicle shall be kept in working condition or shall be replaced with equivalent equipment. [Ref. Iowa Code §321.387 (1991); 74th G.A., eff. 7/1/92] SEC. 455. REQUIRED USAGE OF LIGHTING DEVICES. Whenever a motor vehicle is being operated on a roadway or shoulder adjacent thereto during the times specified in Sections 436 and 437, the driver shall use a distribution of light, or composite beam, directed high enough and of sufficient intensity to reveal persons and vehicles at a safe distance in advance of the vehicle, subject to the following requirements and limitations: Whenever a driver of a vehicle approaches an oncoming vehicle within one hundred feet, such driver shall use a BOOK 3O? PAGE 295 Ordinance No. 3878 Page 2 distribution of light, or composite beam, so aimed that the glaring rays are not projected into the eyes of the oncoming driver. The lowermost distribution of light, or composite beam, specified in Subsection 2 of Section 454 shall be deemed to avoid glare at all times, regardless of road contour and loading. Whenever the driver of a vehicle follows another vehicle within four hundred feet to the rear, except when engaged in the act of overtaking and passing, such driver shall use a distribution of light permissible under this ordinance other than the uppermost distribution of light specified in subsection 1 of Section 454. The above paragraphs do not apply to motorcycles or motorized bicycles being operated between sunrise and sunset. ('91 Rev.) [Ref. Iowa Code §321.415 (1991); 74th G.A., eff. 7/1/92] SEC. 491. SAFETY BELTS AND SAFETY HARNESSES --USE REQUIRED. 2. ... This subsection does not apply to: ... (e) A person possessing a written certification from a physician on a form provided by the Iowa Department of Transportation that the person is unable to wear a safety belt or safety harness due to physical or medical reasons. The certification shall specify the time period for which the exemption applies. The time period shall not exceed twelve months, at which time a new certification may be issued unless the certifying physician is from a United States military facility, in which case the certificate may specify a longer period of time or a permanent exemption.
