AN ORDINANCE VACATING A PORTION OF THE STREET RIGHT OF
WAY GENERALLY LOCATED ALONG THE NORTHERLY SIDE OF THE
EAST SAN MARNAN DRIVE FRONTAGE ROAD, EAST OF KIMBALL
AVENUE IN THE CITY OF WATERLOO, BLACK HAWK COUNTY, IOWA,
AND RESCINDING ORDINANCE NO. 3869.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
as follows:
That part of the Southwest Quarter (SW a) of Section
Three (3), Township Eighty-eight North (T88N), Range
Thirteen West (R13W) of the Fifth Principal Meridian,
City of Waterloo, Iowa, also known as part of East San
Marnan Drive, described as follows:
Beginning at the Southwest corner of Tract A of
Brookeridge First Addition, Waterloo, Black Hawk County,
Iowa; thence S88°30'44"E Two Hundred Twenty-five and
Twenty-two Hundredths (225.22) feet along the South line
of Tract A to the Southeast corner of Tract A; thence
SO1°01'W Thirty-four (34) feet; thence N88°30'45"W One
Hundred Seventy-five and Twenty-four Hundredths (175.24)
feet along a line parallel with the South line of Tract
A; thence N54°45'50"W Sixty-one and Eighteen Hundredths
(61.18) feet to the point of beginning, shall be and the
same hereby vacated, subject to the City's retention of
a permanent utility easement over, under and above the
above described property, all in the City of Waterloo,
Black Hawk County, Iowa.
BE IT FURTHER ORDAINED that Ordinance No. 3869 shall be and
the same hereby rescinded in its entirety due to an error in the
legal description.
