HomeMy WebLinkAbout3889-09/14/1992ORDINANCE NO. 3889 AN ORDINANCE AMENDING WATERLOO ZONING ORDINANCE NO. 2479, AS AMENDED, BY: REPEALING SUBSECTIONS (D) AND (E) OF SECTION 2A-55, AMENDMENTS, OF PART XXVI, AMENDMENTS; AND ENACTING IN LIEU THEREOF A NEW SUBSECTION (D) TO SECTION 2A-55, AMENDMENTS; REPEALING SECTION 2A-59, FEES, OF PART XXVIII-A, FEES; AND ENACTING IN LIEU. THEREOF A NEW SECTION 2A-59, FEES. BE IT ORDAINED by the City Council of the City of Waterloo, Iowa: That. Subsections (D) and (E) of Section 2A-55, Amendments, of Part XXVI, Amendments, of the Waterloo Zoning. Ordinance No. 2479, as amended, are hereby repealed in their entirety; that a new Subsection (D) of Section 2A-55, Amendments, of Part XXVI, Amendments, of the Waterloo Zoning Ordinance No. 2479, as amended, is hereby enacted in lieu thereof as follows: (D) Before any action shall be taken as provided in this part, the party or parties proposing or recommending a change in the district regulations or district boundaries shall deposit with the City Treasurer one of the following to cover the costs of this procedure and under no condition -shall said sum or any part thereof be refunded for failure of said amendment to be enacted into law: 1. One hundred dollars ($100.00) if less than one (1) acre adjoining the same or less restrictive zone. 2. One hundred fifty dollars ($150.00) if lessthan. one (1) acre not adjoining the same or less restrictive zone. 3. Two hundred dollars ($200.00) if more than one (1) acre adjoining the same or less. restrictive zone. 4. Two hundred fifty dollars ($250.00) if more than one (1) acre not adjoining the same or less restrictive zone. That Section 2A-59, Fees, of Part XXVIII-A, Fees, of the Waterloo Zoning Ordinance No. 2479, as amended, is hereby repealed in its entirety; that a new Section 2A-59, Fees, of Part XXVIII-A, Fees., of the Waterloo Zoning Ordinance No. 2479, as amended, is hereby enacted in lieu thereof as follows: 2A-59. FEES. A. General Fees. Upon submission of the application and site plan to the Waterloo Planning, Programming and Zoning Commission as required by Sections 2A-23, 2A-39, 2A-43 and 2A-48, a fee shall be paid according to the following fee schedule: 1. "S-1" Shopping Center District, "R -P" Planned Residence Districts and "M -2,P" Planned Industrial District. Site Plans a. Overall (if different than site plan submitted with original zoning_ request) . . . . $40.00 b. Individual Building Site Plans [if different than submitted under (a) above and subject to Commission review] $25.00 2. Special Permit Site Plans (churches, schools., etc.) $25.00 B. Vacation Fees.. Upon submission of a petition to the Waterloo Planning, Programming and Zoning Commission to BOOK 3O3 PAGE Its? Ordinance No. 3889 P;Age 2 vacate an entire public right-of-way, or portion thereof (i.e. streets, alleys, etc.) or easement (public utility, draining, sewer, etc.), an application fee shall be paid according to the following fee schedule: 1.
