ORDINANCE NO. 3924
AN ORDINANCE VACATING A PORTION OF STREET
RIGHT OF WAY GENERALLY LOCATED AT THE
NORTHEAST CORNER OF SAN MARNAN DRIVE AND 1-380
AND RESCINDING ORDINANCE NO. 3911 IN ITS
ENTIRETY.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
as follows:
That part of the Southeast Quarter (SE t) of Section thirty-
six (36), Township Eighty-nine North (T89N), Range Thirteen
West (R13W), and that part of the Southwest Quarter (SW t) of
Section thirty-one (31), Township Eighty-nine North (T89N),
Range Twelve West (R12W) of the Fifth Principal Meridian, City
of Waterloo, Iowa, described as follows:
Commencing at a point on the East line of said Southeast
Quarter (SE t) which is Two Hundred Ninety-eight and Forty-
nine hundredths (298.49) feet North of the Southeast corner of
said Southeast Quarter (SE t), said point also lying on the
South line of Plymouth Avenue as platted in "Garden Place" in
the City of Waterloo, Iowa; thence S89°2530"W along said
South line One hundred forty—eight and Seventy-five hundredths
(148.75) feet to the point of beginning of the parcel herein
described; thence N42°18'00"W Eighty-one and Twelve hundredths
(81.12) feet along the Northeasterly line of Highway No. 1-380
to the North line of Plymouth Avenue; thence N89°28'50"E Two
Hundred Eleven and Twenty-one hundredths (211.21) feet to the
West line of Texas Street; thence S21°04'30"E Sixty-four and
Forty-two hundredths (64.42) feet to the South line of
Plymouth Avenue; thence S89°25'30"W along said South line One
Hundred Seventy-nine and Seventy-eight hundredths (179.78)
feet to the point of beginning, containing approximately
11,819 S.F., all in the City of Waterloo, Black Hawk County,
Iowa,
shall be, and the same is hereby vacated, with the City's retention
of an utility easement over, under, and above the northerly 30 feet
in even width of above described parcel.
BE IT FURTHER ORDAINED that Ordinance No. 3911 be and the same
hereby rescinded due to an error in the legal description.
