AN ORDINANCE VACATING PORTIONS OF STREET
RIGHTS OF WAY GENERALLY LOCATED IN WALNER
HEIGHTS ADDITION IN THE CITY OF WATERLOO,
BLACK HAWK COUNTY, IOWA.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
that the following street rights of way:
Columbia Street from the Northerly right-of-way line of Donald
Street to the Northerly line of Walner Heights, Waterloo,
Black Hawk County, Iowa and described as follows:
Commencing at the Southeast corner of Lot 80 Walner Heights;
thence Northerly along the Westerly line of Columbia Street a
distance of 1289.2 feet to the Northerly line of said Walner
Heights; thence Easterly along said Northerly line of Walner
Heights a distance of 60.0 feet; thence Southerly along the
Easterly line of Columbia Street a distance of 1289.2 feet to
the Northerly right-of-way line of Donald Street; thence
Westerly along the Northerly right-of-way of Donald Street a
distance of 60.0 feet to the point of beginning, containing
77,532 sq. ft., all in the City of Waterloo, Black Hawk
County, Iowa;
and also
Michael Avenue from the Westerly right-of-way line of Columbia
Street as platted in Walner Heights, Waterloo, Black Hawk
County, Iowa to the Southerly extension of the Westerly line
of Lot 25, Walner Heights and described as follows:
Commencing at the Northeast corner of Lot 41, Walner Heights;
thence Westerly along the Southerly right-of-way line of
Michael Avenue a distance of 987.50 feet to the Southerly
extension of the Westerly line of Lot 25, Walner Heights;
thence Northerly along said Southerly extension a distance of
66.0 feet to the Southwest corner of Lot 25, Walner Heights;
thence Easterly along the Northerly right-of-way line of
Michael Avenue a distance of 987.60 feet to the Westerly
right-of-way line of Columbia Street; thence Southerly along
the Westerly right-of-way line of Columbia Street a distance
of 66.0 feet to the point of beginning, containing
approximately 65,184.9 sq. ft., all in the City of Waterloo,
Black Hawk County, Iowa;
and also
Midland Street from Easterly right-of-way line of Fairview
Avenue as extended Northerly to the Westerly right-of-way line
of Columbia Street as extended Northerly as platted in Walner
Heights, Waterloo, Black Hawk County, Iowa and described as
follows:
Commencing at the Northwesterly corner of Lot 20, Walner
Heights; thence Northerly along an extension of the Easterly
right-of-way line of Fairview as extended Northerly a distance
of 33.0 feet to the Northerly line of Walner Heights; thence
Easterly along the Northerly line of Walner Heights a distance
of 1236.2 feet to the Westerly right-of-way line of Columbia
Street as extended Northerly; thence Southerly along the
Westerly right-of-way line of Columbia Street as extended a
distance of 33.0 feet to the Northeast corner of Lot 1, Walner
Heights; thence Westerly along the Southerly right-of-way line
of Midland Street a distance of 1236.2 feet to the point of
beginning, containing 40,794.6 sq. ft., all in the City of
Waterloo, Black Hawk County, Iowa;

shall be, and the same are hereby vacated, subject to the City's
retention of a permanent sanitary sewer easement between the North
line of Donald Street to the North line of Michael Avenue, all in
the City of Waterloo, Black Hawk County, Iowa.
