HomeMy WebLinkAbout3951-06/28/1993ORDINANCE NO. 3951 ORDINANCE AMENDING ORDINANCE NO. 2479, AS AMENDED, BY ADDING SUBSECTION NO. 46 TO SECTION 2A-5, REZONING CERTAIN PROPERTY. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA: Section 1. That Section 2A-5, of Ordinance No. 2479, as amended, be further amended by adding after Subsection No. 45, of said Section, the following Subsection No. Forty-six (46). "46. A part of the NW 4 of Section 11-88-13 described as follows: Beginning at the Southeast corner of Lot 9, Southtown, Waterloo, Black Hawk County, Iowa; thence S 89°28'00" W along the South line of said Southtown a distance of 1182.43 feet to the Easterly right-of-way of Hammond Avenue; thence S 05°30'00" E along said Easterly right-of-way line a distance of 264.50 feet to the Northerly right-of-way line of U.S. 20; thence S 88°42'30" E along said Southerly right-of-way line a distance of 1157.18 feet; thence N 00°01'34" E a distance of 300.37 feet to the point of beginning, containing approximately 329,541 SF (7.565 ac), all in the City of Waterloo, Black Hawk County, Iowa; The South line of Southtown, Waterloo, Black Hawk County, Iowa is assumed to bear S 89°28'00" W, now zoned on the Zoning Map of Waterloo, Iowa, as "A-1" Agricultural District to "C-2" Commercial District/"C-Z" Conditional Zoning, subject to the following conditions: 1. The use of the property is restricted to the mini -storage facility and outside storage lot and subject to a site plan amendment for future uses. 2. The proposed storage buildings will be located no closer than 50 feet from the highway right-of-way line. 3. If any portion of this property is sold, a 50 foot wide easement of access is required from Southtown Drive to the storage facility site. 4. In accordance with the requirements of Ordinance No. 3805, as amended, the "H -C" Highway Corridor Overlay District, the property will be landscaped as it is developed. 5. The open parking lot will be screened from U.S. Highway 20 by additional landscaping." Section 2. That the Acting Clerk/Auditor be, and she is hereby directed to file a certified copy of this Ordinance with the Recorder of Black Hawk County, Iowa.
