HomeMy WebLinkAbout3964-08/09/1993ORDINANCE NO. 3964 AN ORDINANCE AMENDING WATERLOO ZONING ORDINANCE NO. 2479, AS AMENDED, BY REPEALING SUBSECTION (D) LARGE SITES OF SECTION 2A -19A, LANDSCAPING REGULATIONS, OF PART IX, "R-3" MULTIPLE RESIDENCE DISTRICT; AND BY ENACTING IN LIEU THEREOF A NEW SUBSECTION (D) ALTERNATIVE COMPLIANCE OF SECTION 2A -19A, LANDSCAPING REGULATIONS, OF PART IX, "R-3" MULTIPLE RESIDENCE DISTRICT. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA: That Subsection (D) Large Sites of Section 2A -19A, Landscaping Regulations, of Part IX, "R-3" Multiple Residence District, is hereby repealed in its entirety; that a new Subsection (D) Alternative Compliance of Section 2A -19A, Landscaping Regulations, of Part IX, "R-3" Multiple Residence District, is hereby enacted in lieu as follows: D. Alternative Compliance For sites larger than two acres in area or those with difficult site conditions, the City Planner or his/her designated representative may approve the plan if the following findings are made: 1. The proposed improvements will fulfill an individual and/or community need and will not adversely affect the goals of the Land Use Policy Plan; and 2. The proposed improvements, because of the conditions that have been applied to it, will not be detrimental to the health, safety and general welfare of persons residing or working in the area and will not adversely affect other property in the vicinity; and 3. The proposed improvements will meet the purpose and intent of this part.
