RESOLUTION CONFIRMING APPROVAL OF PLANS,
SPECIFICATIONS, FORM OF CONTRACT, ETC. , IN

CONJUNCTION WITH THE F. Y. 2009 RIVERVIEW
o c RECREATIONAL TRAIL, CONTRACT NO. 726 .

- WHEREAS, the City Council of the City of Waterloo, Iowa,
heretofore instructed the City Engineer of said City to prepare
proposed plans, specifications, form of contract, etc . , for the
F. Y. 2009 Riverview Recreational Trail, Contract No. 726, in the
City. of Waterloo, Iowa, and
WHEREAS, said City Engineer did file said preliminary plans,
specifications, form of contract, etc . , for the F. Y. 2009
Riverview Recreational Trail, Contract No. 726, which were
preliminarily approved on February 2 , 2009, and
WHEREAS, a public hearing, upon notice, was held on
February 23 , 2009 .
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that said proposed plans, specifications, form of
contract, etc . , for the F. Y. 2009 Riverview Recreational Trail,
Contract No. 726, in the City of Waterloo, Iowa, be, and the same
are hereby, approved as filed.
PASSED AND ADOPTED this 23rd day of February, 2009 .

C ^ c RESOLUTION ORDERING THE CONSTRUCTION OF THE
....'7' F.Y. 2009 RIVERVIEW RECREATIONAL TRAIL,
s '--' CONTRACT NO. 726 .

~ ` WHEREAS, by Resolution No. 2009-134 , plans, specifications,
form of contract, etc . , for the F. Y. 2009 Riverview Recreational
Trail, Contract No. 726, in the City of Waterloo, Iowa, have been
approved and adopted by this Council after the hearing prescribed
by -statute .
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that it is deemed advisable and necessary and it
is so ordered on motion by this Council that the said
improvements be constructed in accordance with said plans and
specifications .
That the work herein ordered is to be paid in monthly
estimates, in cash, on the basis of 90 percent of the work as the
same is completed and materials delivered and the work approved,
except that before the last month' s payment is made the
contractor may be required to furnish the City Council vouchers
showing that all subcontractors and workmen and persons
furnishing materials have been fully paid for such materials and
labor, and that the City may retain the last month' s payment for
a period of 31 days following such completion and approval,
unless satisfied that materials, men and laborers have been paid.
That said work shall be done by contract and shall be
commenced promptly after receipt of "Notice to Proceed" .

GRANDSTAND STRUCTURAL REPAIRS .

WHEREAS, the City Council of the City of Waterloo, Iowa,
c= heretofore instructed the Leisure Services Director of said City
to prepare proposed plans, specifications, form of contract,
etc . , for the 2009 Riverfront Stadium Grandstand Structural
Repairs, in the City of Waterloo, Iowa, and
WHEREAS, said Leisure Services Director did file said
preliminary plans, specifications, form of contract, etc . , for
the 2009 Riverfront Stadium Grandstand Structural Repairs, which
were preliminarily approved on February 2, 2009, and
WHEREAS, a public hearing, upon notice, was held on
February 23 , 2009 .
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that said proposed plans, specifications, form of
contract, etc . , for the 2009 Riverfront Stadium Grandstand
